A BILL

TO AMEND CHAPTER 33, TITLE 59, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY DESIGNATING SECTIONS 59-33-10 THROUGH 59-33-110 AS ARTICLE 1, ENTITLED "GENERAL PROVISIONS", AND BY ADDING ARTICLE 3 SO AS TO ESTABLISH AND PROVIDE FOR THE STATE AUTISM TRAINING CENTER, TO DEFINE CERTAIN TERMS, TO PROVIDE FOR THE POWERS AND DUTIES OF THE STATE BOARD OF EDUCATION AND THE CENTER, AND TO PROVIDE FOR EXPENSES, COSTS, AND CHARGES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.     Sections 59-33-10 through 59-33-110 of the 1976 Code are designated Article 1, Chapter 33, Title 59 of the 1976 Code entitled "General Provisions".

SECTION    2.    Chapter 33, Title 59 of the 1976 Code is amended by adding:

"Article 3

State Autism Training Center

Section 59-33-310.    For purposes of this article:

(1)    'Board' means the South Carolina State Board of Education.

(2)    'Center' means the State Autism Training Center.

(3)    'Client' means a person with the primary diagnosis of autism or autistic-like behavior.

(4)    'Expenses' means expenditures related to training and treatment of eligible clients as defined in the rules adopted and regulations promulgated by the center.

Section 59-33-320.    (A)    The board may operate a center including:

(1)    acquiring by purchase, lease, gift, or otherwise, necessary lands and constructing necessary buildings;

(2)    expanding, remodeling, altering, or equipping necessary buildings; and

(3)    providing for the equipment, expenses, compensation of personnel, operation and maintenance of an agency or institution utilized for the purposes of this article.

(B)    The board, or its designee, may enter into contracts necessary to perform its powers and duties pursuant to this section, and may cooperate with other agencies of the state, county, and federal governments.

Section 59-33-330.    The center shall offer education and training for professional personnel and family members or guardians through identification, evaluation, education, individual training, and treatment programs for clients.

Section 59-33-340.    The board, after consulting the center, shall adopt rules, promulgate regulations, and set standards for the establishment, operation, cost reimbursement, fees for services, maintenance, and government control of the center established pursuant to this article, including rules, regulations, and standards necessary for compliance with existing or future federal statutes pertaining to grants-in-aid for client training or facilities and other rules and regulations necessary to effectuate the purposes of this article.

Section 59-33-350.    The board shall appoint an advisory board of citizens of the State to advise the center's director on policy matters. The advisory board must be composed of:

(1)    ten parents or guardians of clients eligible for the center's program;

(2)    eight persons from professional fields related to autism, such as special education, psychology, hearing and speech, neurology, and pediatrics;

(3)    two knowledgeable lay citizens such as legislators or other lay community leaders; and

(4)    the director of the center as an ex officio nonvoting member.

Section 59-33-360.    (A)    The primary method of providing services through the center is through trainee teams. A trainee team consists of:

(1)    an eligible client;

(2)    a professional chosen by the primary local service agency; and

(3)    the client's parent or guardian.

(B)    The center may charge an agency a fee and reimburse a trainee team or a client for those expenses as provided by rules and regulations. The center also may provide for reasonable and customary expenses in excess of a fee charged an agency for each trainee team or otherwise eligible client, including childcare for another child of an attending parent or guardian or another person, as specified in rules and regulations."

SECTION    3.    This act takes effect upon approval by the Governor.
