A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-5-713 SO AS TO PROVIDE THAT A LAW ENFORCEMENT AGENCY MAY NOT CONDUCT A TRAFFIC STOP IN CONJUNCTION WITH A DRIVER'S LICENSE CHECK OR A MOTOR VEHICLE REGISTRATION CHECK AT A CHECKPOINT ESTABLISHED TO STOP ALL DRIVERS BETWEEN SEVEN O'CLOCK A.M. AND NINE O'CLOCK A.M., AND BETWEEN FOUR O'CLOCK P.M. AND SIX O'CLOCK P.M.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 5, Chapter 5, Title 56 of the 1976 Code is amended by adding:

"Section 56-5-713.    Notwithstanding another provision of law, a law enforcement agency may not conduct a traffic stop in conjunction with a driver's license check or a motor vehicle registration check at a checkpoint established to stop all drivers between seven o'clock a.m. and nine o'clock a.m., and between four o'clock p.m. and six o'clock p.m."

SECTION    2.    This act takes effect upon approval by the Governor.
