A BILL

TO AMEND SECTION 59-150-60, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO POWERS OF THE SOUTH CAROLINA LOTTERY COMMISSION, SO AS TO AUTHORIZE AND DIRECT THE COMMISSION TO ESTABLISH A SOUTH CAROLINA PALMETTO FUND DESIGNED TO PROVIDE AN INDIVIDUAL ACCOUNT FROM WHICH A PERSON ELIGIBLE TO PLAY THE LOTTERY MAY MAKE AN ON-LINE PURCHASE OF A LOTTERY SHARE; AND TO AMEND SECTION 59-150-70, RELATING TO REGULATION OF TICKET SALES, SO AS TO PROVIDE FOR THE ON-LINE PURCHASE OF A LOTTERY SHARE THROUGH FUNDS DEPOSITED IN THE SOUTH CAROLINA PALMETTO FUND THROUGH A CREDIT CARD TRANSACTION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 59-150-60 of the 1976 Code, as added by Act 59 of 2001, is amended by adding:

"(I)(1)    The commission is authorized and directed to establish a financial account to be called 'South Carolina Palmetto Account'. The account must be designed to provide on-line access to a person eligible to play the South Carolina Education Lottery for the purposes of:

(a)    establishing an individual account;

(b)    making deposits into the account;

(c)    monitoring the account; and

(d)    debiting the account exclusively for the on-line purchase of lottery tickets as provided in this subsection.

(2)    Funds deposited in an individual account described in item (1) do not accrue interest and are not refundable. An account showing no activity for a year is considered abandoned and the funds on deposit become the funds of the commission for use in the same manner as unclaimed prize monies.

(3)    Deposits to an individual account may be made by:

(a)    electronic transaction from the purchaser's financial institution;

(b)    presentation of certified funds; or

(c)    credit card, except that a deposit by credit card is limited to five dollars a day.

(4)    The commission shall develop procedures and promulgate regulations that provide for the establishment of an individual account in the South Carolina Palmetto Fund by a person eligible to play the South Carolina Education Lottery so that the person may purchase shares in a lottery game on-line by deducting the cost of the purchase from his individual account. The shares must provide all options available for purchase of a lottery ticket and must be treated for all purposes like a lottery ticket.

(5)    The commission may designate which lottery games may be played through shares purchased on-line.

(6)    The South Carolina Palmetto Account and the offering of on-line purchases of lottery shares must be in effect by July 1, 2005."

SECTION    2.    Section 59-150-70(D)(2) of the 1976 Code, as added by Act 59 of 2001, is amended to read:

"(2)    sale price of lottery game tickets or shares and the manner of sale except that all sales must be for cash only, except as provided in Section 59-150-60(I). Payment by checks, credit cards, charge cards, or other form of deferred payment and payment by debit card are prohibited, except as provided in Section 59-150-60(I);"

SECTION    3.    This act takes effect upon approval by the Governor.
