A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-19-555 SO AS TO PROVIDE THAT THE DEPARTMENT OF NATURAL RESOURCES MAY NEGOTIATE A RECIPROCAL AGREEMENT WITH THE AUTHORITIES OF THE STATE OF NORTH CAROLINA TO ALLOW RECIPROCAL FISHING AND MIGRATORY WATERFOWL HUNTING ON FRESHWATER RIVERS AND LAKES ON THE COMMON BOUNDARY BETWEEN SOUTH CAROLINA AND NORTH CAROLINA.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 19, Title 50 of the 1976 Code is amended by adding:

"Section 50-19-555.    (A)    The department may negotiate an agreement with the proper representatives of the State of North Carolina to allow reciprocal fishing and migratory waterfowl hunting on freshwater rivers and lakes on the common boundary between South Carolina and North Carolina to licensed residents of both states as specified in the agreement.

(B)    The agreement must provide that a resident of North Carolina who has a fishing license or a hunting license issued by North Carolina may fish or hunt migratory waterfowl on freshwater rivers and lakes of the common border between the two states, and a South Carolina resident holding a South Carolina license is extended equal privileges.

(C)    The agreement may be terminated by the department at any time after ninety days from the day notice of the termination is given by the department.

(D)    All provisions of law relating to reciprocal hunting and freshwater fishing privileges between Georgia and South Carolina residents remain in full force and effect."

SECTION    2.    This act takes effect upon approval by the Governor.
