VERSIONS OF THIS BILL
TO AMEND CHAPTER 43, TITLE 27 OF THE 1976 CODE BY ADDING SECTION 27-43-35 TO PROVIDE AN EASEMENT FOR THE RELATIVES AND DESCENDANTS OF ANY PERSON BURIED IN A CEMETERY FOR INGRESS AND EGRESS FOR THE PURPOSE OF VISITING THE CEMETERY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 43, Title 27 of the 1976 Code is amended by adding:
"Section 27-43-35. The relatives and descendants of any person buried in a cemetery shall have an easement for ingress and egress for the purpose of visiting the cemetery at reasonable times and in a reasonable manner. If the cemetery is abandoned or otherwise not being maintained, such relatives and descendants may request the owner to provide for reasonable maintenance of the cemetery, and, if the owner refuses or fails to maintain the cemetery, the relatives and descendants shall have the right to maintain the cemetery."
SECTION 2. This act takes effect upon approval by the Governor.
