EXPLANATION OF IMPACT:

Enactment of this bill would have no fiscal impact on the General Fund of the State or on federal and/or other funds. The bill specifies a means by which South Carolina State University may acquire land, but does not require the purchase of any land or provide any funds for that purpose.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-127-90 SO AS TO AUTHORIZE THE SOUTH CAROLINA STATE UNIVERSITY BOARD OF TRUSTEES TO USE THE PROVISIONS OF CHAPTER 2, TITLE 28 (EMINENT DOMAIN) TO ACQUIRE LAND FOR WHICH FUNDS ARE PROVIDED BY THE GENERAL ASSEMBLY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 127, Title 59 of the 1976 Code is amended by adding:

"Section 59-127-90.    The Trustees of South Carolina State University, in their discretion, may make use of the provisions of Chapter 2, Title 28 (Eminent Domain Procedure Act) to acquire land for which funds are provided by the General Assembly."

SECTION    2.    This act takes effect upon approval by the Governor.
