THE COMMITTEE ON FISH, GAME AND FORESTRY

To whom was referred a Bill (S. 167) to amend the Code of Laws of South Carolina, 1976, by adding Section 50-5-1707 so as to provide for limits on certain sharks; and to amend Section 50-5-2725, etc., respectfully

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-5-1707 SO AS TO PROVIDE FOR LIMITS ON CERTAIN SHARKS; AND TO AMEND SECTION 50-5-2725, AS AMENDED, RELATING TO SHARK CATCH LIMITS, SO AS TO MAKE TECHNICAL CHANGES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 5, Title 50 of the 1976 Code is amended by adding:

"Section 50-5-1707.    (A)    When taken for other than a commercial purpose, it is lawful to take or have in possession in the waters of this State in any one day no more than:

(1)    two Atlantic sharpnose sharks (Rhizoprionodon terraenovae) per person;

(2)    one bonnethead shark (Sphyrna tiburo) per boat.

(B)    A bonnethead shark taken lawfully in state waters for other than a commercial purpose may be of any size.

(C)    The species named in this section must be brought to the dock or landed with head and tail fin intact.

(D)    Returning fish named in this section to the water if taken in excess of the limits does not constitute a violation."

SECTION    2.    Section 50-5-2725(A) of the 1976 Code, as last amended by Act 342 of 2002, is further amended to read:

"(A)    The Except as provided in this chapter, the size, catch, bag, and possession limits, fishing period closures, and requirements pertaining to the taking, release, landing, sale, purchase, trade, or barter of sharks or shark parts prescribed by those federal regulations implemented under the Fishery Conservation and Management Act (PL 94-265) are declared to be the law of this State and apply statewide including in state waters. In state waters federal size, catch, bag, and possession limits pertain to individual fishermen when no vessel is utilized."

SECTION    3.    This act takes effect upon approval by the Governor.
