A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-318 SO AS TO PROVIDE THAT HUNTERS MUST WEAR A HAT, COAT, OR VEST OF SOLID VISIBLE INTERNATIONAL ORANGE WHEN HUNTING WITH CERTAIN FIREARMS, TO PROVIDE EXCEPTIONS, AND TO PROVIDE PENALTIES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    The 1976 Code is amended by adding:

"Section 50-11-318.    (A)    Except as provided in this section, a hunter must wear either a hat, coat, or vest of solid visible international orange when hunting during any gun season. As used in this section, gun season includes use of a center fire or rim fire rifle, shotgun, pistol, or muzzle loading firearms. This section does not apply when hunting for migratory birds, turkey, or while small game hunting at night.

(B)    A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not less than twenty-five dollars nor more than two hundred dollars or imprisoned not more than thirty days, or both."

SECTION    2.    This act takes effect upon approval by the Governor.
