To whom was referred a Bill (H. 3297) to amend Section 40-60-150, as amended, Code of Laws of South Carolina, 1976, relating to investigations, restraining orders, licensing, and procedural requirements for real estate appraisers, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/    SECTION    1.    Section 40-60-150(C)(3) of the 1976 Code, as last amended by Act 335 of 2000, is further amended to read:

"(3)    The board shall render a decision and shall serve notice, in writing within thirty days one hundred twenty days, of the board's decision to the applicant or appraiser charged. The board also shall state in the notice the date the ruling or decision becomes effective.

SECTION    2.    Section 40-60-150(C) of the 1976 Code is amended by adding at the end to read:

(4)        An applicant who petitions the board for licensure must be notified, in writing within thirty days, of the board's decision."

SECTION    3.    This act takes effect upon approval by the Governor. /

Renumber sections to conform.

Amend title to conform.

EXPLANATION OF IMPACT:

The Department of Labor, Licensing, and Regulation has indicated this bill would not have any impact on the department, the General Fund of the State, or on federal and/or other funds. The bill relates to investigations, restraining orders, licensing, and procedural requirements.

A BILL

TO AMEND SECTION 40-60-150, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO INVESTIGATIONS, RESTRAINING ORDERS, LICENSING, AND PROCEDURAL REQUIREMENTS FOR REAL ESTATE APPRAISERS, SO AS TO REMOVE THE TIME LIMIT THE BOARD HAS TO RENDER A DECISION AND SERVE NOTICE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 40-60-150(C)(3) of the 1976 Code, as last amended by Act 335 of 2000, is further amended to read:

"(3)    The board shall render a decision and shall serve notice, in writing within thirty days, of the board's decision to the applicant or appraiser charged. The board also shall state in the notice the date the ruling or decision becomes effective."

SECTION    2.    This act takes effect upon approval by the Governor and applies to hearings conducted after that date.
