THE COMMITTEE ON WAYS AND MEANS

To whom was referred a Bill (H. 3741) to amend Section 8-17-370, as amended, Code of Laws of South Carolina, 1976, relating to exemptions from the State Employees Grievance Procedure Act, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking SECTION 1 and inserting:

/SECTION    1.    Section 8-17-370 of the 1976 Code, as last amended by Act 177 of 1993, is further amended by adding a new item appropriately numbered to read:

"( )    Employees determined by the Office of Human Resources of the Budget and Control Board to be within two managerial levels of the agency head or equivalent position." /

Amend further, as and if amended, by striking the title and inserting:

A BILL

TO AMEND SECTION 8-17-370, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM THE STATE EMPLOYEES GRIEVANCE PROCEDURE ACT, SO AS TO EXEMPT EMPLOYEES IN A CHIEF OF STAFF OR EQUIVALENT POSITION, THOSE EMPLOYEES AS DETERMINED BY THE OFFICE OF HUMAN RESOURCES OF THE BUDGET AND CONTROL BOARD TO BE WITHIN TWO MANAGERIAL LEVELS OF EITHER THE AGENCY HEAD OR THE CHIEF OF STAFF OR EQUIVALENT POSITION, AND ANY EMPLOYEES EARNING AN ANNUAL EQUIVALENT SALARY IN EXCESS OF EIGHTY THOUSAND DOLLARS, TO PROVIDE EXCEPTIONS, AND TO PROVIDE A PROCEDURE TO ADJUST THE EIGHTY THOUSAND DOLLAR FIGURE REFERENCED ABOVE EVERY FOUR YEARS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 8-17-370 of the 1976 Code, as last amended by Act 177 of 1993, is further amended by adding a new item appropriately numbered to read:

"( )    Employees in a chief of staff or equivalent position, those employees as determined by the Office of Human Resources of the Budget and Control Board to be within two managerial levels of either the agency head or the chief of staff or equivalent position, and any employees earning an annual equivalent salary in excess of eighty thousand dollars excluding academic employees referenced in Section 8-17-380. In 2006 and every four years thereafter, this eighty thousand dollar annual equivalent salary figure must be adjusted to reflect any cumulative percentage increase in the consumer price index over the previous four-year period. The accumulation over the four-year period must exclude the consumer price index increase for any years in which state employees did not receive a general salary increase."

SECTION    2.    This act takes effect upon approval by the Governor.
