STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT1/

The Board of Economic Advisors has reviewed the bill and has determined that there is no impact on state general or other fund revenue in FY2003-04.

Explanation

According to Department of Health and Environmental Control (DHEC) officials, this bill would correct a typographical error and add a clarifying provision to SC Code Section 44-7-170(A)(2) regarding the Certificate of Need (CON) program's exemption for licensed physicians. According to DHEC officials, changes made by this bill would not effect the CON program or impact CON fee revenue transferred to the general fund pursuant to SC Code Sections 44-7-150(5) and 180(D) because regulations governing the CON program already recognize and account for the provisions of this bill for administrative and regulatory purposes. Because this bill conforms statute to current regulatory practice and because it does not otherwise effect the CON program or impact CON fee revenue transferred to the general fund pursuant to SC Code Sections 44-7-150(5) and 180(D), this bill is not expected to impact state general or other fund revenue in FY2003-04.

A BILL

TO AMEND SECTION 44-7-170, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO INSTITUTIONS AND TRANSACTIONS EXEMPT FROM THE STATE CERTIFICATION OF NEED AND HEALTH FACILITY LICENSURE ACT, SO AS TO REVISE THE EXEMPTION FOR OFFICES OF LICENSED PRIVATE PRACTITIONERS AND REQUIRE THAT A LICENSED PRIVATE PRACTITIONER OBTAIN A CERTIFICATE OF NEED FROM THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL BEFORE UNDERTAKING CONSTRUCTION OR ESTABLISHMENT OF A NEW HEALTH CARE FACILITY OR ACQUIRING CERTAIN MEDICAL EQUIPMENT USED FOR DIAGNOSIS OR TREATMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-7-170(A)(2) of the 1976 Code is amended to read:

"(2)    the offices of a licensed private practitioner whether for individual or group practice except as provided for in Section 44-7-160(7) 44-7-160(1) and (6);"

SECTION    2.    This act takes effect upon approval by the Governor.
