A BILL

TO AMEND SECTION 40-6-240, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO LICENSE RENEWAL REQUIREMENTS, SO AS TO PROVIDE THAT AN AUCTIONEER WHO IS SIXTY-FIVE YEARS OF AGE AND HAS BEEN LICENSED AS AN AUCTIONEER FOR TWENTY-FIVE YEARS OR MORE IS EXEMPT FROM THE ANNUAL CONTINUING EDUCATION REQUIREMENT.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 40-6-240(B) of the 1976 Code, as added by Act 318 of 2000, is amended to read:

"(B)    When a licensee applies for renewal, the licensee shall submit proof with the renewal form, in a form acceptable to the commission, that the licensee has acquired commission-approved continuing education of at least four hours within the previous twelve months. Continuing education is not required of apprentice auctioneers and, auction firm license holders unless the owner or manager is a licensed auctioneer, and auctioneers who are sixty-five years of age or older and who have been licensed twenty-five years or more."

SECTION    2.    This act takes effect upon approval by the Governor.
