STATEMENT OF ESTIMATED FISCAL IMPACT

REVENUE IMPACT 1/

The Board of Economic Advisors has reviewed the bill and determined that there will be no impact on general fund revenue in FY 2003-04.

Explanation

This bill requires the State Budget & Control Board to deed the property described in Act 1645 of 1972 to the Department of Disabilities and Special Needs and allows any proceeds from the sale of this property be retained by the department. The sale of this property is a one-time real estate sale by the Department of Disabilities and Special Needs that would not be included in the BEA's general fund revenue estimate. Consequently, the BEA will not adjust its general fund revenue estimate for FY 2003-04.

A BILL

TO CONFIRM THE OWNERSHIP BY THE SOUTH CAROLINA DEPARTMENT OF DISABILITIES AND SPECIAL NEEDS OF REAL PROPERTY DESCRIBED IN ACT 1645 OF 1972, TO DIRECT THE STATE BUDGET AND CONTROL BOARD TO DEED THE PROPERTY TO THE DEPARTMENT, AND TO ALLOW THE DEPARTMENT THE PROCEEDS OF ANY SALE OF THE PROPERTY.

Whereas, in Act 1645 of 1972, the General Assembly authorized the transfer from South Carolina Department of Mental Health to the South Carolina Department of Mental Retardation a tract of real property in Richland County of two hundred eighty-five acres and in that act provided a legal description of the property and a plat reference; and

Whereas, no deed was executed to accomplish this transfer; and

Whereas, for purposes of any subsequent transfer of the property it is necessary to confirm ownership of the tract by the South Carolina Department of Disabilities and Special Needs as the successor agency of the South Carolina Department of Mental Retardation and execute a deed conveying the property to the South Carolina Department of Disabilities and Special Needs; Now, therefore,

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    (A)    Upon execution of the deed as provided in subsection (B) of this section, ownership of the tract of real property in Richland County described in Section 1 of Act 1645 of 1972 is confirmed in the South Carolina Department of Disabilities and Special Needs as the successor agency to the South Carolina Department of Mental Retardation.

(B)    The State Budget and Control Board shall cause to be executed and recorded an appropriate deed conveying the tract to the South Carolina Department of Disabilities and Special Needs.

(C)    Proceeds of a subsequent sale of the tract that is the subject of this section may be retained by the South Carolina Department of Disabilities and Special Needs.

SECTION    2.    This act takes effect upon approval by the Governor.
