THE COMMITTEE ON MEDICAL,

MILITARY, PUBLIC AND MUNICIPAL AFFAIRS

To whom was referred a Bill (H. 4791) to amend Section 59-101-290, Code of Laws of South Carolina, 1976, relating to notification of risks of contracting certain diseases if living on campus, so, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by deleting all after the enacting words and inserting:

/ SECTION    1.    Section 59-101-290(B) of the 1976 Code, as added by Act 317 of 2002, is amended to read:

(B)    A public institution of higher learning shall include information about vaccination against meningococcal disease and Hepatitis B as recommended immunization in health and medical information provided to students or prospective students and parents or guardians . The vaccination information must be contained on student health forms provided to each student by an institution of higher learning and must include space for the student to indicate whether or not the student has received the vaccinations against meningococcal disease and Hepatitis B. The vaccination information about meningococcal disease and Hepatitis B must include recommendations issued by the national Centers for Disease Control and Prevention regarding the diseases. The vaccination information obtained pursuant to this section that is in the possession of the institutions of higher learning is confidential and must not be a public record. This section must not be construed to require an institution of higher learning to provide vaccinations to students for meningococcal disease or Hepatitis B. This section does not create a private right of action."

SECTION    2.    This act takes effect upon approval by the Governor. /

EXPLANATION OF IMPACT:

The Commission on Higher Education indicates enactment of this bill would likely require public institutions to revise their immunization literature. Currently institutions are only required to recommend vaccinations against meningococcal disease and Hepatitis B in their immunization literature. There is no requirement to provide information about the vaccinations. Since health literature is updated or printed on a regular basis, the cost incurred to make necessary changes would be minimal and could be absorbed by the institutions.

A BILL

TO AMEND SECTION 59-101-290, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO NOTIFICATION OF RISKS OF CONTRACTING CERTAIN DISEASES IF LIVING ON CAMPUS, SO AS TO CONFORM THE SECTION TO FEDERAL AND STATE PUBLISHED IMMUNIZATION RECOMMENDATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 59-101-290(B) of the 1976 Code, as added by Act 317 of 2002, is amended to read:

"(B)    A public institution of higher learning shall include information about vaccination against meningococcal disease and Hepatitis B as recommended immunization in health and medical information provided to students or prospective students and parents or guardians."

SECTION    2.    This act takes effect upon approval by the Governor.
