A BILL

TO AMEND SECTION 44-79-110, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO EXEMPTIONS FROM THE PHYSICAL FITNESS SERVICES ACT, SO AS TO INCLUDE AS EXEMPT ENTITIES CERTAIN GYMNASTICS SCHOOLS AND COUNTRY CLUBS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 44-79-110 of the 1976 Code is amended to read:

"Section 44-79-110.    This chapter does not apply to:

(1)    The the State of South Carolina and its political subdivisions;

(2)    and any a not-for-profit corporations corporation are exempt from the terms of this chapter.;

(3)    a gymnastics school engaging only in instruction and training to which exercise is merely incidental; and

(4)    a country club whose primary function is to provide social and recreational amenities to its members and for whom a program of physical fitness services and access to a facility is merely incidental to membership. For purposes of this item, 'country club' means an entity that offers its members, their families and guests, a variety of social and recreational services including, but not limited to, social events, access to dining, banquet, catering, and lounge facilities, swimming, yachting, golf, tennis, recreational card games, and special programs and events."

SECTION    2.    This act takes effect upon approval by the Governor.
