TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 6-9-75 SO AS TO AUTHORIZE A BUILDING CODES ENFORCEMENT OFFICER TO DENY A BUILDING PERMIT TO A LICENSED BUILDER UNDER CERTAIN CIRCUMSTANCES.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 9, Title 6 of the 1976 Code is amended by adding:
"Section 6-9-75. (A) A building codes enforcement officer may deny a licensed builder a building permit within his jurisdiction if:
(1) the building codes enforcement officer has been granted this authority by the municipality or county for whom the officer is employed;
(2) the building codes enforcement officer has filed a complaint with the Department of Labor, Licensing and Regulation concerning previous projects by the builder; and
(3) the builder, in the opinion of the building codes enforcement officer, has demonstrated a less than satisfactory record of compliance with building codes.
(B) A denial of a building permit must be in writing and sent to the builder and the Department of Labor, Licensing and Regulation."
SECTION 2. This act takes effect upon approval by the Governor.
