A BILL

TO AMEND CHAPTER 1 OF TITLE 2, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE GENERAL ASSEMBLY, BY ADDING SECTION 2-1-200 SO AS TO DEVOLVE ALL POWERS, DUTIES, AND RESPONSIBILITIES GRANTED TO COUNTY LEGISLATIVE DELEGATIONS WHICH AFFECT ONLY ONE COUNTY TO THE COUNTY GOVERNING BODY, EXCEPT THOSE POWERS RELATING TO STATEWIDE OR REGIONAL BOARDS, COMMISSIONS, OR OTHER ENTITIES THAT HAVE REPRESENTATIVES ON THE GOVERNING BOARD FROM MORE THAN ONE COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 2 of the 1976 Code is amended by adding:

"Section 2-1-200.    All powers, duties, and responsibilities granted by statute or resolution to any county legislative delegation which affects only one county are devolved upon the county governing body of that county. The provisions of this section shall not apply to the activities, powers, duties, or responsibilities of legislative delegations with regard to statewide or regional boards, commissions, authorities, or any other governmental entity that has representatives on its governing body from more than one county.

For the purposes of this section, county legislative delegation is defined to include each member of the House of Representatives and of the Senate whose district includes any portion of the geographic area of a given county."

SECTION    2.    The Code Commissioner is empowered and directed to modify all code sections which are inconsistent with this act.

SECTION    3.    This act takes effect upon approval by the Governor.
