VERSIONS OF THIS BILL
TO AMEND SECTION 56-5-3810, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO A DRIVER BACKING A VEHICLE, SO AS TO PROVIDE THAT NO DRIVER SHALL BACK A TRAILER, SEMITRAILER, OR POLE TRAILER, DRAWN BY A VEHICLE OFF OF OR ONTO A ROADWAY OR HIGHWAY UNLESS THE TRAILER, SEMITRAILER, OR POLE TRAILER IS EQUIPPED WITH CERTAIN SAFETY LAMPS AND REFLECTORS AND THE DRIVER USES LIGHTED FLARES OR A FLAG PERSON.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 56-5-3810 of the 1976 Code is amended to read:
"Section 56-5-3810. (a)(A) No driver shall back a vehicle unless such movement can be made with safety and without interfering with other traffic.
(b)(B) No driver shall back a vehicle upon any shoulder or roadway of any controlled-access highway.
(C) No driver shall back a trailer, semitrailer, or pole trailer, drawn by a vehicle off of or onto a roadway or highway unless:
(1) the trailer, semitrailer, or pole trailer is equipped on each side with three side-marker lamps, one at or near the front, one at or near the middle, and one at or near the rear;
(2) the trailer, semitrailer, or pole trailer is equipped on each side with a strip of light reflecting paint, tape, or reflectors where practical; and
(3) the driver places lighted flares in the center of the lane of traffic at a distance of approximately one hundred feet from the vehicle in any direction in which other vehicles might approach, or a flag person is located at a distance of approximately one hundred feet from the vehicle in any direction in which other vehicles might approach."
SECTION 2. This act takes effect upon approval by the Governor.
