A BILL

TO AMEND SECTION 25-1-3235, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO ELIGIBILITY FOR THE NATIONAL GUARD PENSION AND THE ESTABLISHMENT OF THE NATIONAL GUARD PENSION FUND, SO AS TO EXTEND ELIGIBILITY FOR THE NATIONAL GUARD PENSION PROSPECTIVELY TO OTHERWISE ELIGIBLE PERSONS WHO BECAME A MEMBER OF THE NATIONAL GUARD AFTER JUNE 30, 1993.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 25-1-3235 of the 1976 Code, as last amended by Act 85 of 2001, is further amended to read:

"Section 25-1-3235.    (A)    Notwithstanding any other provision of this article, a person who becomes a member of the National Guard after June 30, 1993, is ineligible to receive the pension authorized by this article.

(B)    Persons with a break in service remain eligible for pension benefits under this article if the person was a member of the National Guard prior to June 30, 1993.

(C)    There is established the National Guard Pension Fund which must be managed by the State Budget and Control Board as other state retirement system funds are managed. The State Treasurer shall invest the fund as the funds of other state retirement systems are invested. This fund, together with monies that may be appropriated for the purpose, must be used to pay the pensions authorized by this article. The General Assembly annually shall appropriate sums sufficient over time to establish and maintain the fund on an actuarial basis as determined by the State Budget and Control Board."

SECTION    2    This act takes effect July 1, 2005, but the amendment to Section 25-1-3235 of the 1976 Code contained in this act applies only for National Guard Pension benefits payable after June 30, 2005.
