THE COMMITTEE ON MEDICAL AFFAIRS

To whom was referred a Bill (H. 4556) to amend the Code of Laws of South Carolina, 1976, by adding Section 44-96-323 so as to provide that no more than fifty percent of the waste, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/SECTION    __.    Section 44-96-290(E) of the 1976 Code is amended by adding at the end:

"Notwithstanding any other provision of law, a privately owned commercial solid waste landfill, in existence on July 1, 2006, may not expand the volume of the existing landfill or construct a new landfill unless it meets the demonstration of need requirements promulgated by the department in regulation, and no variance for a privately owned commercial solid waste landfill may be granted. The requirements of this subsection supercede department demonstration of need regulations for solid waste facilities."

SECTION    2.    This act takes effect July 1, 2006./

ESTIMATED FISCAL IMPACT ON GENERAL FUND EXPENDITURES:

$0 (No additional expenditures or savings are expected)

EXPLANATION OF IMPACT:

There will be no fiscal impact on the General Fund of the State or on federal and/or other funds.

LOCAL GOVERNMENT IMPACT:

Spartanburg County indicates that the actual fiscal impact is not known at this time. However, preliminary estimates indicate that requirements of the proposed bill could reduce estimated county receipts by as much as $1 million.

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-96-323 SO AS TO PROVIDE THAT NO MORE THAN FIFTY PERCENT OF THE WASTE RECEIVED BY A REGIONAL SOLID WASTE LANDFILL IN SPARTANBURG COUNTY, INITIALLY PERMITTED AFTER JUNE 30, 2006, MAY BE GENERATED OUTSIDE OF SPARTANBURG COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 2, Chapter 96, Title 44 of the 1976 Code is amended by adding:

"Section 44-96-323.    Notwithstanding any other provision of law, no more than fifty percent of the waste received by a regional solid waste landfill in Spartanburg County, initially permitted after June 30, 2006, may be generated outside of Spartanburg County."

SECTION    2.    This act takes effect July 1, 2006.
