A BILL

TO AMEND SECTION 59-25-10, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE EMPLOYMENT OF A TEACHER WHOSE IMMEDIATE FAMILY MEMBER SERVES ON THE BOARD OF TRUSTEES, SO AS TO INCLUDE SPOUSE IN THE DEFINITION OF IMMEDIATE FAMILY MEMBER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1.    Section 59-25-10 of the 1976 Code is amended to read:

"Section 59-25-10.    No A person who is a member of the board of trustees or a member of the immediate family of a member of the board of trustees of any a school district shall must not be employed by the board as a teacher without the written approval of the board of trustees of the district and, when applicable, of the board of education of the county, or unless a majority of the parents or guardians of the children attending the school for which such the teacher is employed requests such the employment in writing. The provisions of this section shall do not apply to any a teacher who was employed prior to the time he or his family member became a board member. For purposes of this section, the immediate family of a member of the board of trustees shall include includes only his spouse, parents, children, brothers or sisters. Provided, that the provisions of this section shall do not apply to school bus drivers."

SECTION 2.    This act takes effect upon approval by the Governor.
