A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 17-3-75 SO AS TO PROVIDE THAT WITH THE APPROVAL OF THE BOARD OF DIRECTORS OF THE COUNTY DEFENDER CORPORATION AND THE GOVERNING BODY OF THE COUNTY A PUBLIC DEFENDER AND EMPLOYEES IN THE OFFICE OF PUBLIC DEFENDER ARE DEEMED COUNTY EMPLOYEES, AND THE OFFICE OF PUBLIC DEFENDER IS DEEMED A COUNTY GOVERNMENT AGENCY, AND TO PROVIDE THAT THIS DESIGNATION MUST NOT BE CONSTRUED AS DIMINISHING THE AUTHORITY OR THE AUTONOMY OF THE COUNTY DEFENDER CORPORATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 1, Chapter 3, Title 17 of the 1976 Code is amended by adding:

"Section 17-3-75.    (A)    With the approval of the board of directors of the county defender corporation by resolution adopted at a meeting of the board and subsequent acceptance by the governing body of the county by resolution, the public defender and employees in the office of the public defender are deemed county employees and the office of public defender is deemed an agency of county government for all purposes except as provided in subsection (B) of this section.

(B)    Nothing in subsection (A) of this section may be construed as diminishing the authority or autonomy of a county defender corporation established pursuant to this article."

SECTION    2.    This act takes effect upon approval by the Governor.
