A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTIONS 56-15-361, 56-15-601, AND 56-16-211 SO AS TO PROVIDE THAT THE DEPARTMENT OF MOTOR VEHICLES MAY IMPOSE AN ADMINISTRATIVE FINE AGAINST A MOTOR VEHICLE DEALER OR WHOLESALER WHO HAS VIOLATED A PROVISION RELATED TO DEALING IN MOTOR VEHICLES, TO PROVIDE FOR THE ADMINISTRATIVE REVIEW OF A FINE IMPOSED PURSUANT TO THESE SECTIONS, AND TO PROVIDE FOR THE DISPOSITION OF THE FINES COLLECTED PURSUANT TO THESE PROVISIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 3, Chapter 15, Title 56 of the 1976 Code is amended by adding:

"Section 56-15-361.    The department may impose and collect an administrative fine of not more than one thousand dollars for each violation against a licensee if it finds that the licensee has violated a provision of this section or has violated any other law of this State related to dealing in motor vehicles. A licensee is entitled to a hearing pursuant to the Administrative Procedures Act if the licensee contests a fine imposed upon him. The fines collected pursuant to this section shall be placed into a special restricted account by the Comptroller General to be used to defray the expenses of the department's dealer licensing and audit unit."

SECTION    2.    Article 5, Chapter 15, Title 56 of the 1976 Code is amended by adding:

"Section 56-15-601.    The department may impose and collect an administrative fine of not more than one thousand dollars for each violation against a licensee if it finds that the licensee has violated a provision of this section or has violated any other law of this State related to dealing in motor vehicles. A licensee is entitled to a hearing pursuant to the Administrative Procedures Act if the licensee contests a fine imposed upon him. The fines collected pursuant to this section shall be placed into a special restricted account by the Comptroller General to be used to defray the expenses of the department's dealer licensing and audit unit."

SECTION    3.    Chapter 16 of Title 56 of the 1976 Code is amended by adding:

"Section 56-16-211.    The department may impose and collect an administrative fine of not more than one thousand dollars for each violation against a licensee if it finds that the licensee has violated a provision of this section or has violated any other law of this State related to dealing in motor vehicles. A licensee is entitled to a hearing pursuant to the Administrative Procedures Act if the licensee contests a fine imposed upon him. The fines collected pursuant to this section shall be placed into a special restricted account by the Comptroller General to be used to defray the expenses of the department's dealer licensing and audit unit."

SECTION    4.    This act takes effect upon approval by the Governor.
