THE COMMITTEE ON EDUCATION AND PUBLIC WORKS

To whom was referred a Bill (H. 3882) to amend the Code of Laws of South Carolina, 1976, by adding Article 10 to Chapter 3, Title 56 so as to provide that the Department of Motor Vehicles may, etc., respectfully

REPORT:

That they have duly and carefully considered the same and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting:

/ SECTION    1.    Chapter 3, Title 56 of the 1976 Code is amended by adding:

"Article 10

Year of Manufacture Motor Vehicle License Plates

Section 56-3-1450.    (A)    An owner of a motor vehicle that is thirty years old or older, may apply to the department to use a license plate issued by this State in the year corresponding to the model year of the vehicle, if the license plate is legible and serviceable, as determined by the department. The department shall promulgate regulations establishing the criteria it will use to determine whether a year of manufacture plate is legible and serviceable. If the department determines that the plate is legible and serviceable, the applicant must submit the regular vehicle registration fee contained in Article 5, Chapter 3, of this title, and the special license plate fee required by Section 56-3-2020. The biannual renewal fee for these plates shall be the regular vehicle registration fee contained in Article 5, Chapter 3, of this title, and the special license plate fee required by Section 56-3-2020.

(B)    Once the department approves use of the plate and the applicant submits the required fees, the department shall register the plate to the applicant. The department may not register any duplicate plates. The applicant may only use the special license plate on the vehicle with which the license plate registration corresponds.

(C)    License plates registered pursuant to this section may only be transferred to vehicles of the same model year as year the license plate was originally issued."

SECTION    2.    This act takes effect six months after the approval by the Governor. /

A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 10 TO CHAPTER 3, TITLE 56 SO AS TO PROVIDE THAT THE DEPARTMENT OF MOTOR VEHICLES MAY ALLOW YEAR OF MANUFACTURE LICENSE PLATES TO SERVE AS THE OFFICIAL LICENSE PLATES FOR CERTAIN MOTOR VEHICLES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 56 of the 1976 Code is amended by adding:

"Article 10

Year of Manufacture Motor Vehicle License Plates

Section 56-3-1450.    (A)    An owner of a motor vehicle that is a 1972 or older model year vehicle, after the requirements for the registration of the vehicle have been complied with and with the approval of the department, may utilize license plates of this State with the date of year corresponding to the model year date when the vehicle was manufactured, if the model year date license plate is legible and serviceable, as determined by the department, instead of the license plates required by this chapter. The department may consult with an organization of antique car hobbyists to determine whether the date of year of the license plate to be used corresponds to the model year date when the motor vehicle was manufactured.

(B)    A fee of thirty-five dollars must be charged for the application for use of these special license plates.

(C)    In addition to the regular renewal fee for the vehicle for which the plates are authorized, the applicant for a renewal of the plates must be charged an additional fee of ten dollars. When payment of a regular vehicle renewal fee is not required by this chapter, the holder of any license plates with a date corresponding to the model year may retain the plates upon payment of an annual fee of twenty dollars, which must be paid at the expiration of the registration year of the motor vehicle to which the plate was last assigned under this section.

(D)    Whenever a person who has been authorized to utilize the special license plates contained in this article applies to the department for transfer of the plates to another vehicle, a transfer fee of twelve dollars must be charged in addition to any other appropriate fees."

SECTION    2.    This act takes effect upon approval by the Governor.
