TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-1-340 SO AS TO PROVIDE THE OWNER OF REAL PROPERTY IS NOT LIABLE IN A CIVIL ACTION FOR ACTS OR OMISSIONS CAUSING INJURY TO A PERSON WHO TRESPASSES ON HIS PROPERTY TO COMMIT A CRIME OR WHEN REASONABLE FORCE IS USED TO REMOVE A PERSON WHO IS TRESPASSING ON HIS PROPERTY.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 1, Title 15 of the 1976 Code is amended by adding:
"Section 15-1-340. (A) The owner of real property is not liable in a civil action for acts or omissions causing injury to a person who trespasses on his property for the purpose of committing a crime or that occur during the commission of a crime.
(B) The owner of real property is authorized to use reasonable force to remove a person who is trespassing on his property and is not liable in a civil action when reasonable force is used as provided in this subsection."
SECTION 2. This act takes effect upon approval by the Governor.
