TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 56-1-55 SO AS TO PROVIDE THAT IT IS UNLAWFUL FOR A PERSON TO OPERATE A MOTOR VEHICLE WHILE USING A HANDHELD CELLULAR TELEPHONE OR ANOTHER HANDOPERATED COMMUNICATIONS DEVICE, AND TO PROVIDE PENALTIES FOR VIOLATIONS OF THIS PROVISION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 1, Title 56 of the 1976 Code is amended by adding:
"Section 56-1-55. (A) It is unlawful for a person to operate a motor vehicle while using a handheld cellular telephone or another handoperated communications device when the vehicle is in motion.
(B) A person who violates this provision is guilty of a misdemeanor and, upon conviction, for a:
(1) first offense must have his driver's license suspended for not more than thirty days;
(2) second offense must have his driver's license suspended for not more than six months; and
(3) third offense must have his driver's license suspended for not more than one year."
SECTION 2. This act takes effect upon approval by the Governor.
