A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 16-17-447 SO AS TO PROVIDE THAT NO PERSON IN ANY DOCUMENT DELIVERED TO A CONSUMER BY MAIL OR OTHER FORM OF DELIVERY SOLICITING THE SALE OF SOME TYPE OF SERVICE OR PRODUCT MAY USE A DERIVATION OF THE NAME OF A STATE OR LOCAL GOVERNMENTAL ENTITY IN THE DOCUMENT WHICH A REASONABLE PERSON WOULD ASSUME IS AN OFFICIAL DOCUMENT FROM THAT GOVERNMENTAL ENTITY REQUIRING ACTION ON THE CONSUMER'S PART, AND TO PROVIDE PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 17, Title 16 of the 1976 Code is amended by adding:

"Section 16-17-447.    No person in any document delivered to a consumer by mail or other form of delivery soliciting the sale of some type of service or product may use a derivation of the name of a state or local governmental entity in the document which a reasonable person would assume is an official document from that governmental entity requiring action on the consumer's part.

Any person delivering such a document to a consumer is guilty of a misdemeanor and, upon conviction, must be fined not more than two hundred dollars or imprisoned for not more than thirty days. Each violation constitutes a separate offense."

SECTION    2.    This act takes effect upon approval by the Governor.
