A BILL

TO AMEND CHAPTER 79, TITLE 38, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO MEDICAL MALPRACTICE INSURANCE, BY ADDING SECTION 38-79-35 SO AS TO PROVIDE CHARITABLE IMMUNITY TO HEALTH CARE PROVIDERS WHO PROVIDE PRO BONO CARE AND TO CLARIFY SECTION 38-79-30.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 79, Title 38 of the 1976 Code is amended by adding:

"Section 38-79-35.    Any health care provider who notifies his patient prior to treatment, both in person and stated on his record, that the provider's treatment will be provided pro bono, shall have his services considered within the scope of Section 38-79-30 and the Charitable Immunity Statute."

SECTION    2.    This act takes effect upon approval by the Governor.
