VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-55-822 SO AS TO REQUIRE THAT A SOIL SUITABILITY TEST BE CONDUCTED AND THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL APPROVE AN INDIVIDUAL WASTE TREATMENT AND DISPOSAL SYSTEM FOR A SPECIFIC RESIDENTIAL LOT IN A SUBDIVISION BEFORE THE CLOSING ON THE SALE OF THAT LOT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 9, Chapter 55, Title 44 of the 1976 Code is amended by adding:
"Section 44-55-822. Notwithstanding any other provision of law, an individual residential lot in a subdivision may not be sold unless a soil suitability test has been conducted and an individual waste treatment and disposal system has been approved by the department for that specific lot prior to the closing on the sale of the lot."
SECTION 2. This act takes effect two months after approval by the Governor.
