VERSIONS OF THIS BILL
TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 11-35-1515 SO AS TO PROVIDE FOR A "TRUTH IN BIDDING" POLICY IN CONNECTION WITH SOURCE SELECTION PURSUANT TO STATE CONTRACTS SUBJECT TO THE CONSOLIDATED PROCUREMENT CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Subarticle 3, Article 5, Chapter 35, Title 11 of the 1976 Code is amended by adding:
"Section 11-35-1515. Notwithstanding a statutory provision, regulation, or practice to the contrary, a bidder must not be considered the lowest responsive and responsible bidder for purposes of awarding a state contract pursuant to Section 11-35-1510 if the bid amount:
(1) contains hidden fees or charges;
(2) anticipates, contemplates, or necessitates costly change orders; or
(3) in any way results or would result in an increase of the approved budgeted amount."
SECTION 2. This act takes effect upon approval by the Governor and applies to all solicitations for bids issued after that date.
