A BILL

TO AMEND CHAPTER 11, TITLE 8, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 13 SO AS TO PROVIDE A STATE EMPLOYEE PAY-CAREER INCENTIVE PLAN, TO PROVIDE THE ELEMENTS OF THE CAREER INCENTIVE PLAN AND TO PROVIDE FOR ITS ADMINISTRATION BY THE OFFICE OF HUMAN RESOURCES OF THE STATE BUDGET AND CONTROL BOARD; AND TO REPEAL ARTICLE 11, CHAPTER 11, OF TITLE 8 RELATING TO STATE EMPLOYEE PAY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 11, Title 8 of the 1976 Code is amended by adding:

"Article 13

State Employee Pay - Career Incentive Plan

Section 8-11-1310.    It is the policy of this State to compensate its employees at a level sufficient to encourage excellence of performance and to maintain the labor market competitiveness necessary to recruit and retain a competent work force. To this end, salary increases to state employees must be implemented through the Career Incentive Plan based upon the individual performance of each state employee. The Career Incentive Plan shall combine salary increases and awards into an interrelated system of compensation that furthers the recruitment, retention, career service, and outstanding performance of state employees.

Section 8-11-1320.    As used in this article:

(1)    'Career incentive plan award' means an annual salary increase awarded to a state employee whose annual performance appraisal indicates job performance that meets or exceeds management's expectations.

(2)    'Cost of living adjustment' means a general salary increase given to state employees in response to inflation.

(3)    'OHR' means the Office of Human Resources of the State Budget and Control Board.

Section 8-11-1330.    To guide the Governor and the General Assembly in budget making to fund the Career Incentive Plan, the OHR shall conduct an annual compensation survey. The director of OHR shall present the results of the compensation survey to the Governor, the House Ways and Means Committee, and the Senate Finance Committee no later than December first of each year.

Section 8-11-1340.    (A)    The Career Incentive Plan consists of the following components:

(1)    the career incentive plan award; and

(2)    the cost of living adjustment.

The career incentive plan award must be the primary method by which an employee progresses through the employee's salary range and must be awarded annually to employees who qualify for the award. An employee may receive, within a twelve-month period, the career incentive plan award, if the employee's job performance equals or exceeds the level of performance provided pursuant to subsection (B)(4) of this section.

(B)    Career incentive plan awards must be based on annual performance appraisals of all employees conducted by each department, agency, and institution. The OHR shall adopt policy and promulgate regulations for performance appraisal. The policy and regulations must include the following:

(1)    The performance appraisal system of each department, agency, or institution must be designed and administered to ensure that career incentive plan awards are distributed fairly.

(2)    To be eligible to distribute career incentive plan awards, a department, agency, or institution must have an operative performance appraisal system which has been approved by OHR. The performance appraisal system adopted must adhere to modern personnel management techniques and practices in common use in the public and private sectors.

(3)    The director of OHR shall assist departments, agencies, and institutions to establish and administer their performance appraisal systems and shall provide initial and ongoing training in performance appraisal and performance system administration.

(4)    An employee whose performance is rated at or above 'meets' shall receive a career incentive plan award. The career incentive plan award must equal a three percent increase within the employee's assigned pay band. An award may not increase an employee's compensation above the maximum of the range. Other than the OHR, an agency, department, or institution may not set limits so as to preclude an employee whose performance meets or exceeds management's expectations and performance requirements from receiving a career incentive plan award.

(5)    The director of OHR shall monitor the distribution of cost of living increases and career incentive plan awards within each department, agency, and institution. Each department, agency, and institution shall submit to the director annual reports which must include data on the demographics of the distribution of salary increases and career incentive plan awards, and the implementation schedule for salary increases and career incentive plan awards.

(6)    The director of OHR shall report annually on the Career Incentive Plan. The report shall evaluate the performance of each department, agency, and institution in the administration of its cost of living increases and career incentive plan awards within each department, agency, and institution and across state government. Copies of the report must be sent to the Governor, Lieutenant Governor, President Pro Tempore of the Senate, Speaker of the House of Representatives, the respective chairmen of the Senate Finance Committee and the House Ways and Means Committee, standing personnel committees of the House of Representatives, and the State Auditor. The report also must be available on the OHR website.

Section 8-11-1350.    The Governor and the General Assembly, as appropriate, shall advance the Career Incentive Plan by recommending and making annual appropriations to the Career Incentive Plan. The career incentive plan award component must be funded each year at the level required for full implementation as provided by this article.

Section 8-11-1360.    For the purposes of this article, local health care providers of the Department of Disabilities and Special Needs, Division of Mental Retardation, Department of Alcohol and Other Drug Abuse Services, and the South Carolina Division on Aging are eligible for the Career Incentive Plan.

Section 8-11-1370.    Funding for bonus payments when provided are given to reward exceptional service. Bonus payments must be given in accord with rules established by the State Budget and Control Board. The amounts provided for bonus payments must be provided in the annual general appropriations act in terms of a percentage of agency payrolls and in dollar figures."

SECTION    2.    Article 11, Chapter 11, Title 8 of the 1976 Code is repealed.

SECTION    3.    This act takes effect upon approval by the Governor.
