A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING ARTICLE 101 TO CHAPTER 3, TITLE 56 SO AS TO PROVIDE THAT THE DEPARTMENT OF MOTOR VEHICLES MAY ISSUE MOTOR VEHICLE REPAIR TEST-DRIVING LICENSE PLATES AND TO PROVIDE A PENALTY FOR THE MISUSE OF THESE LICENSE PLATES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 3, Title 56 of the 1976 Code is amended by adding:

"Article 101

Motor Vehicle Repair Test-Driving License Plates

Section 56-3-10020.    (A)    Upon application and payment of the required fee, the Department of Motor Vehicles may issue not more than four motor vehicle repair test-driving license plates to a motor vehicle repair business or garage. The license plates must be used exclusively on motor vehicles, including motorcycles in the possession of a motor vehicle repair business or garage that are being test-driven.

(B)    A motor vehicle repair business or garage shall apply for this license plate on a form prescribed by the department and shall provide proof that the applicant is licensed by a local governmental agency and maintains a surety bond for at least twenty-five thousand dollars. The cost of each license plate is twenty dollars and is valid for one year.

(C)    A vehicle with a motor vehicle repair test-driving license plate may be operated by a person authorized by the motor vehicle repair business or garage on the state's streets and highways only for test-driving of the vehicle.

(D)    A motor vehicle repair business or garage that violates the provisions regarding the use of this license plate is subject to a civil fine of not more than one thousand dollars for each violation."

SECTION    2.    This act takes effect upon approval by the Governor.
