TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ENACTING THE "SOUTH CAROLINA SCHOOL DROP-OUT PREVENTION ACT OF 2008" BY ADDING SECTION 59-63-1415 SO AS TO PROVIDE THAT BEGINNING WITH THE 2008-2009 SCHOOL YEAR THE STATE DEPARTMENT OF EDUCATION, WITHIN AVAILABLE FUNDS PROVIDED BY THE GENERAL ASSEMBLY, SHALL ESTABLISH IN CONJUNCTION WITH LOCAL SCHOOL OFFICIALS, ALTERNATIVE SCHOOLS IN THOSE DISTRICTS OR COMBINATION OF DISTRICTS WHERE ALTERNATIVE SCHOOLS ARE NOT YET ESTABLISHED AND FOR WHICH THERE IS A JUSTIFIED NEED; AND TO PROVIDE THAT BEGINNING WITH SCHOOL YEAR 2008-2009, STUDENTS WHO HAVE DROPPED OUT OF SCHOOL OR WHO HAVE BEEN EXPELLED OR SUSPENDED FROM SCHOOL ALSO MAY ATTEND ALTERNATIVE SCHOOLS IN THE MANNER AND UNDER THE CONDITIONS PROVIDED BY THE STATE DEPARTMENT OF EDUCATION BY REGULATION.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. This act is known and may be cited as the "South Carolina School Drop-out Prevention Act of 2008".
SECTION 2. Chapter 63, Title 59 the 1976 Code is amended by adding:
"Section 59-63-1415. (A) Beginning with the 2008-2009 school year the State Department of Education, within available funds provided by the General Assembly, shall establish in conjunction with local school officials, alternative schools in those districts or combination of districts where alternative schools are not yet established and for which there is a justified need.
(B) Beginning with the 2008-2009 school year, students who have dropped out of school or who have been expelled or suspended from school also may attend alternative schools in the manner and under the conditions provided by the State Department of Education by regulation."
SECTION 3. This act takes effect upon approval by the Governor.
