A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 50-11-525 SO AS TO PROVIDE THAT NOTWITHSTANDING ANOTHER PROVISION OF LAW, THE SEASON FOR HUNTING A MALE WILD TURKEY IN GAME ZONE 5 IS MARCH 15 THROUGH MAY 1, INCLUSIVE; AND TO AMEND SECTION 50-11-310, AS AMENDED, RELATING TO OPEN SEASON FOR ANTLERED DEER, SO AS TO PROVIDE FOR THE USE OF A PRIMITIVE WEAPON, FIREARM AND ARCHERY EQUIPMENT DURING THE SAME SEASON IN GAME ZONE 5.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Article 3, Chapter 11, Title 50 of the 1976 Code is amended by adding:

"Notwithstanding another provision of law, the season for hunting and taking a male wild turkey (gobbler) in Game Zone 5 is March 15 through May 1 inclusive."

SECTION    2.    Section 50-11-310(A)(5) of the 1976 Code, as last amended by Act 289 of 2006, is further amended to read:

"(5) Game Zone 10: September first through January first with bow and arrow only and with firearms September fifteenth through January first.

(5)    In Game Zone 5: August 15 through January 1, with archery equipment, a primitive weapon, and a firearm."

SECTION    3.    If any section, subsection, paragraph, subparagraph, sentence, clause, phrase, or word of this act is for any reason held to be unconstitutional or invalid, such holding shall not affect the constitutionality or validity of the remaining portions of this act, the General Assembly hereby declaring that it would have passed this act, and each and every section, subsection, paragraph, subparagraph, sentence, clause, phrase, and word thereof, irrespective of the fact that any one or more other sections, subsections, paragraphs, subparagraphs, sentences, clauses, phrases, or words hereof may be declared to be unconstitutional, invalid, or otherwise ineffective.

SECTION    4.    This act takes effect July 1, 2007.
