TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 39-5-34 SO AS TO MAKE IT AN UNFAIR TRADE PRACTICE TO USE THE WORDS "SOUTH CAROLINA" OR "STATE" IN A BUSINESS TRADE NAME WITH AN INTENT TO MISLEAD CUSTOMERS OR TO INSTILL FALSE CONFIDENCE IN THE BUSINESS, AND TO PROVIDE CIVIL PENALTIES FOR VIOLATION OF THIS ACT.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Article 1, Chapter 5, Title 39 of the 1976 Code is amended by adding:
"Section 39-5-34. (A) It shall be an unfair trade practice pursuant to Section 39-5-20 to use the words 'South Carolina' or 'State' in a business trade name with an intent to mislead customers as to the involvement of the State in the business or to instill false confidence in the success of potential transactions with the business.
(B) A business that violates the provisions of this section is subject to the provisions, penalties, and damages of the South Carolina Unfair Trade Practices Act."
SECTION 2. This act takes effect upon approval by the Governor.
