A BILL

TO AMEND SECTION 7-13-190, AS AMENDED, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO SPECIAL ELECTIONS TO FILL VACANCIES IN OFFICE, SO AS TO EXEMPT MUNICIPAL ELECTIONS FROM CERTAIN REQUIREMENTS OF THE SECTION REGARDING THE CONDUCT OF THE ELECTION WHEN ONLY ONE PERSON HAS FILED FOR AN OFFICE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 7-13-190(E)(3) of the 1976 Code, as added by Act 3 of 2003, is amended to read:

"(3)    The provisions of this subsection also do not apply to municipal general elections."

SECTION    2.    This act takes effect upon approval by the Governor and applies to all municipal elections conducted after July 1, 2009.
