A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 59-112-140 SO AS TO PROVIDE THAT THE UNIVERSITY OF SOUTH CAROLINA UPSTATE MAY OFFER IN-STATE TUITION TO A STUDENT WHO IS A LEGAL RESIDENT OF RUTHERFORD COUNTY, POLK COUNTY, HENDERSON COUNTY, OR TRANSYLVANIA COUNTY AS LONG AS THE NORTH CAROLINA HIGHER EDUCATION GOVERNING AUTHORITY OFFERS IN-STATE TUITION TO A STUDENT WHO IS A LEGAL RESIDENT OF SPARTANBURG COUNTY OR GREENVILLE COUNTY.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 112, Title 59 of the 1976 Code is amended by adding:

"Section 59-112-140.        The University of South Carolina Upstate may offer in-state tuition to a student who is a legal resident of Rutherford County, Polk County, Henderson County, or Transylvania County of the State of North Carolina as long as the North Carolina higher education governing authority offers in-state tuition to a student who is a legal resident of Spartanburg County or Greenville County of the State of South Carolina."

SECTION    2.    This act takes effect upon approval by the Governor.
