A BILL

TO AMEND CHAPTER 1, TITLE 1 OF THE 1976 CODE, RELATING TO GENERAL PROVISIONS CONCERNING THE ADMINISTRATION OF GOVERNMENT, BY ADDING ARTICLE 27 TO PREVENT CONFLICTS OF INTEREST ARISING THROUGH AGENCY, COMMISSION, BOARD, DEPARTMENT, OR OTHER GOVERNMENTAL AGENCY REPRESENTATION IN CONTESTED CASES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Chapter 1, Title 1 of the 1976 Code is amended by adding:

"Article 27

Attorney Representation

Section 1-1-2000.        No agency, commission, board, department, or other governmental entity may engage private counsel for legal representation in a contested case, as defined in Section 1-23-310, if that person, or an individual with whom he is associated or business with which he is associated, has represented a client for a fee in a contested case before the agency, commission, board, department, or other governmental entity during the previous five years."

SECTION    2.    This act takes effect upon approval by the Governor.
