A BILL

TO AMEND ACT 291 OF 2010, AN ACT TO MAKE APPROPRIATIONS AND TO PROVIDE REVENUES TO MEET THE ORDINARY EXPENSES OF STATE GOVERNMENT FOR THE FISCAL YEAR BEGINNING JULY 1, 2010, SO AS TO PROVIDE THAT, UNLESS OTHERWISE PROHIBITED BY LAW AND NOTWITHSTANDING THE AMOUNTS OF "OTHER FUNDS" APPROPRIATED BY ACT 291, AN AMOUNT EQUAL TO TEN PERCENT OF "OTHER FUNDS" IS TRANSFERRED TO THE STATE GENERAL FUND, AND TO SPECIFY HOW THE TRANSFERRED FUNDS ARE TO BE APPROPRIATED.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.    Section 90 IB of Act 291 of 2010 is amended by adding Section 90.22 to read:

"90.22    (SR: Other Funds Redirected and Appropriated) Unless otherwise prohibited by law and notwithstanding the amounts of 'Other Funds' appropriated in Part IA of this act, an amount equal to ten percent of 'Other Funds' is transferred for deposit into the State General Fund and is appropriated in the following manner:

(1)    twenty percent to fund costs of Medicaid and other health programs;

(2)    twenty percent to fund costs of the K-12 education system;

(3)    twenty percent to fund the costs of disabled children;

(4)    twenty percent to fund the costs of the criminal and civil justice systems; and

(5)    twenty percent to fund the costs of law enforcement and public safety.

The transfer and reappropriation takes place on April 1, 2011. An agency may present a written justification to the House of Representatives Ways and Means Committee and the Senate Finance Committee seeking to have all or part of the transferred 'Other Funds' restored to its appropriations. If the House Ways and Means Committee and the Senate Finance Committee jointly recommend, after public evaluation of an agency's request, that the 'Other Funds' be restored in whole or part to the agency's appropriations, the General Assembly may amend this section to restore the 'Other Funds' to the agency's appropriation."

SECTION    2.    This act takes effect upon approval by the Governor.
