TO APPROVE REGULATIONS OF THE STATE BOARD OF EDUCATION, RELATING TO MINIMUM STANDARDS OF STUDENT CONDUCT AND DISCIPLINARY ENFORCEMENT PROCEDURES TO BE IMPLEMENTED BY LOCAL SCHOOL DISTRICTS, DESIGNATED AS REGULATION DOCUMENT NUMBER 4404, PURSUANT TO THE PROVISIONS OF ARTICLE 1, CHAPTER 23, TITLE 1 OF THE 1976 CODE.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The regulations of the State Board of Education, relating to Minimum Standards of Student Conduct and Disciplinary Enforcement Procedures to be Implemented by Local School Districts, designated as Regulation Document Number 4404, and submitted to the General Assembly pursuant to the provisions of Article 1, Chapter 23, Title 1 of the 1976 Code, are approved.
SECTION 2. This joint resolution takes effect upon approval by the Governor.
The State Board of Education (SBE) proposes to amend R.43-279, Minimum Standards of Student Conduct and Disciplinary Enforcement Procedures to be Implemented by Local School Districts, to change the title of Section V., add a reference to Regulation 43-243, and delete subsections A-E. This proposal is being made because disciplinary procedures for students with disabilities are addressed in Regulation 43-243(v)(B). The SBE also proposes to remove Appendix A as it merely summarizes the regulation and to remove Appendix B as it is simply a listing of state laws.
