THE COMMITTEE ON JUDICIARY

To whom was referred a Bill (S. 1275), to amend Chapter 23, Title 15 of the Code of Laws of South Carolina, 1976, by adding Section 23-15-115, so as to make it unlawful for a public official or public employee who is a law enforcement official to ask or require an employee to participate in partisan political activity, etc., respectfully

REPORT:

That they have duly and carefully considered the same, and recommend that the same do pass with amendment:

Amend the bill, as and if amended, by striking all after the enacting words and inserting therein the following:

/SECTION 1. Chapter 15 of Title 23 of the 1976 Code is amended by adding:

"Section 23-15-115. (A) No public official, public member, or public employee, as defined in Chapter 13 of Title 8, who is a law enforcement official may ask or require an employee of the public official, public member, or public employee to attend or participate in a partisan political meeting, to join a partisan political organization, or to vote for, campaign for, or otherwise support for election that public official, public member, or public employee.

(B) No public official, public member, or public employee, as defined in Chapter 13 of Title 8, who is a law enforcement official may derive any personal income from providing food or any other product or service to a prisoner.

(C) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars or imprisoned for not more than ninety days, or both."

SECTION 2. This act takes effect upon approval by the Governor./

TO AMEND CHAPTER 23, TITLE 15 OF THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 23-15-115 SO AS TO MAKE IT UNLAWFUL FOR A PUBLIC OFFICIAL OR PUBLIC EMPLOYEE WHO IS A LAW ENFORCEMENT OFFICIAL TO ASK OR REQUIRE AN EMPLOYEE TO PARTICIPATE IN PARTISAN POLITICAL ACTIVITY AND TO MAKE IT UNLAWFUL FOR A PUBLIC OFFICIAL OR PUBLIC EMPLOYEE WHO IS A LAW ENFORCEMENT OFFICIAL TO DERIVE INCOME FROM PROVIDING GOODS OR SERVICES TO A PRISONER.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Chapter 15 of Title 23 of the 1976 Code is amended by adding the following section:

"Section 23-15-115. (A) No public official or public employee, as defined in Chapter 13 of Title 8, who is a law enforcement official may ask or require an employee of the public official or public employee to attend or participate in a partisan political meeting, to join a partisan political organization, or to vote for, or otherwise to support for election, any candidate or public official.

(B) No public official or public employee, as defined in Chapter 13 of Title 8, who is a law enforcement official may derive any personal income from providing food or any other product or service to a prisoner.

(C) A person who violates this section is guilty of a misdemeanor and, upon conviction, must be fined not more than one thousand dollars or imprisoned for not more than ninety days."
