A BILL

TO AMEND SECTION 56-5-6430, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO CIRCUMSTANCES WHEN USE OF A CHILD RESTRAINT DEVICE IS NOT REQUIRED, SO AS TO REMOVE THE EXEMPTION FOR FEEDING A CHILD OR FOR A CHILD WITH A MEDICAL PROBLEM AND TO PROVIDE THAT THE EXEMPTION COVERS A CHILD BEING TRANSPORTED WHO IS IN A MEDICAL EMERGENCY SITUATION.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION    1.        Section 56-5-6430 is amended to read:

    "Section 56-5-6430.    The provisions of this article do not apply if a child being transported is in a medical emergency situation or being fed, has a physical impairment, or a medical problem or any distress which makes it impractical to use a child restraint system. Alternate restraint protection, such as safety belts, must be utilized if possible."

SECTION    2.    This act takes effect upon approval by the Governor.
