Our thought for today is from Proverbs 3:5: "Trust in the Lord with all your heart and lean not on your own understanding."
Let us pray. God, consecrate us anew each day for service in the affairs of government. You, O Lord, have entrusted these Representatives and staff with great responsibility. Increase our faith that we may accomplish those things entrusted to us. By Your guidance these Representatives will succeed. Bless our Nation, President, State, Governor, Speaker, this Honorable Assembly, and all who serve in these Halls of Government. Bless our defenders of freedom at home and abroad as they protect us. Hear us as we pray. Amen.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of Friday, the SPEAKER ordered it confirmed.

Be it resolved by the House of Representatives, the Senate concurring:

(1)   That the House of Representatives and the Senate meet in joint session in the Hall of the House of Representatives on Wednesday, May 21, 2008, immediately following the election of a successor to a certain judge of the Court of Appeals and a successor to a certain judge of the family court, for the purpose of electing members of the boards of trustees of the College of Charleston, The Citadel, Clemson University, Coastal Carolina University, Francis Marion University, Lander University, Medical University of South Carolina, South Carolina State University, the University of South Carolina, Wil Lou Gray Opportunity School, and Winthrop University to succeed those members whose terms expire in 2008, or whose positions otherwise must be filled.

(2)   That all nominations be made by the chairman of the Joint Legislative Committee which screened the candidates for the above offices and that no further nominating nor any seconding speeches be made during the joint session by members of the General Assembly on behalf of any of the candidates.

The Concurrent Resolution was agreed to and ordered sent to the Senate.

Whereas, York County's estimated assessment of real and manufacturing property exceeds six hundred forty million dollars, a thirteen percent increase from the previous year and over four percent of the state's total assessment of real and manufacturing property; and

Whereas, last year's thirty-seven announcements of new economic development in York County provided a total investment of over seventy-two million dollars for the State and the creation of more than twelve hundred jobs for South Carolinians; and

Whereas, the citizens of York County passed the county's own one-cent sales tax in 1997 and again in 2003 to collect a total of two hundred seventy-two million dollars to be used to pay for critical road improvements, which also enhance the efficiency of the state's road system; and

Whereas, York County is one of the top three counties in the State in the categories of median household income, percent of academically-gifted students, starting salaries for new teachers, and average salaries for teachers, all of which are important in moving the entire State forward; and

Whereas, the members of the South Carolina General Assembly express their high regard and appreciation for the contributions of York County to our State. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the General Assembly, by this resolution, recognize and honor York County as a vital part of this State, and to declare April 30, 2008, York County Day in South Carolina.

Be it further resolved that a copy of this resolution be forwarded to each of the four chambers of commerce in York County.

(B)   The department must give a person alleged to be in violation of a provision of this section notice and an opportunity for a hearing in accordance with the provisions of the Administrative Procedures Act.   A person aggrieved by an order of the department may request a contested case hearing before the Administrative Law Court in accordance with the Administrative Law Court Rules of Procedure. The department may obtain an order from the Administrative Law Court for enforcement of the department's orders as provided in the Administrative Procedures Act and the Administrative Law Court Rules of Procedure. The proceeding for enforcement must be initiated by filing a petition with the Administrative Law Court in accordance with the Administrative Law Court Rules of Procedure. A copy of the request for a contested case hearing must be served upon all parties of record."

To allow the students, staff, and sponsors of TeenPact to use the chamber of the House of Representatives on Friday, April 4, 2008, from 12:00 noon until 4:00 p.m., for TeenPact students to conduct their annual meeting. If the House of Representatives is in statewide session or its chamber is otherwise unavailable, that chamber may not be used on this date.

Be it further resolved that the State House security forces shall provide assistance and access as necessary for this meeting in accordance with previous procedures.

Be it further resolved that a copy of this resolution be forwarded to Mr. Jonathan Morris of TeenPact.

The following Concurrent Resolution was taken up:

S. 1138 (Word version) -- Senators Peeler and Ritchie: A CONCURRENT RESOLUTION DESIGNATING THE THIRD FULL WEEK OF SEPTEMBER IN EACH YEAR AS "MITOCHONDRIAL DISEASE AWARENESS WEEK".
Whereas, mitochondria are the power plants in every cell of a person's body and create more than ninety percent of the energy needed by the body to sustain life and support growth; and

Whereas, mitochondria may not function correctly due to genetic defects, damage caused by drugs, or damage caused by destructive molecules called free radicals; and
Whereas, when mitochondria fail, cell injury and cell death follow, and if the process is repeated throughout the body, whole systems begin to fail; and

Whereas, mitochondrial diseases can cause isolated symptoms like seizures, low blood counts, blindness, deafness, dementia, heart failure, and progressive muscle weakness, but more often they cause failure of several organ systems in sequence; and

Whereas, mitochondrial diseases can affect any person at any age; and

Whereas, it is estimated that more than one in four thousand children born in the United States each year will develop a mitochondrial disease by ten years of age; and
Whereas, since mitochondrial disorders mimic other diseases, it is believed that they are under diagnosed; and

Whereas, currently no cures or effective therapies exist, but early diagnosis can help patients and their families use proper medication and nutritional supplements to improve the quality of life, and even prolong life; and
Whereas, it is appropriate that all citizens of the State of South Carolina be better informed about mitochondrial diseases and their impact. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the members of the South Carolina General Assembly, by this resolution, do designate the third full week of September in each year as "Mitochondrial Disease Awareness Week" in the State of South Carolina, and the citizens of South Carolina are urged to observe the week with appropriate activities and programs.

The Concurrent Resolution was adopted and sent to the Senate.
