TO AMEND SECTION 7-13-1430, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO THE PROCESSING AND COUNTING OF BALLOTS IN COUNTIES WHERE MARKING DEVICES AND AUTOMATIC TABULATING EQUIPMENT HAVE BEEN ADOPTED, SO AS TO PROVIDE THAT COUNTING STATIONS ESTABLISHED BY THE COUNTY ELECTION COMMISSION TO RECEIVE THESE BALLOTS MUST BE LOCATED IN A PUBLIC BUILDING, AND THAT THE PROCESSING AND COUNTING OF THESE BALLOTS AND THE PREPARATION OF SUMMARY SHEETS IN A GENERAL ELECTION MUST BE DONE IN THE PRESENCE OF A MINIMUM OF THREE WITNESSES FOR EACH POLITICAL PARTY ON THE BALLOT; AND TO AMEND SECTION 7-13-1440, RELATING TO WITNESSES OBSERVING THE FUNCTIONS AT COUNTING STATIONS, SO AS TO PROVIDE THAT THESE WITNESSES SHALL FILE THEIR CERTIFICATES OF APPOINTMENT AT THE PROPER COUNTING STATION AT ANY TIME AFTER 4:00 P.M. ON ELECTION DAY AND THAT WHEN OBSERVING THE COUNTING STATION FUNCTIONS THEY MUST HAVE A FULL VIEW OF THE COUNTING PROCESS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Section 7-13-1430 of the 1976 Code is amended to read:
"Section 7-13-1430. In counties where marking devices and automatic tabulating equipment have been adopted, the county election commission shall establish one or more counting stations to receive voted ballots and other precinct election supplies after the polling precincts are closed. Such These stations shall must be under the supervision and direction of the commission and must be in a public building. Processing and counting of voted ballots and the preparation of summary sheets shall must be done in the presence of witnesses approved by the commission. During a general election a minimum of three witnesses for each political party on the ballot must be allowed but in no instance may one political party be given more witnesses than the other."
SECTION 2. Section 7-13-1440 of the 1976 Code is amended to read:
"Section 7-13-1440. Witnesses shall are not be allowed in the polling place but shall file their certificates of appointment at the proper counting station at any time after 4:00 p.m. on election day after the polls close and may observe all functions there with a full view of the counting process."
SECTION 3. This act takes effect upon approval by the Governor.
