TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 44-41-75 SO AS TO REQUIRE THE LICENSING AND CERTIFICATION OF A HOSPITAL AND CLINIC PERFORMING ABORTIONS IN THIS STATE, PROVIDE FOR REGULATIONS TO FIX A SCHEDULE OF FINES AND PENALTIES, AND PROVIDE FOR THE DEPARTMENT OF HEALTH AND ENVIRONMENTAL CONTROL TO MAINTAIN AN ACTION IN THE NAME OF THE STATE FOR A VIOLATION OF THE LAWS RELATING TO ABORTION; AND TO AMEND SECTION 44-41-70, RELATING TO THE PROMULGATION OF REGULATIONS BY THE DEPARTMENT PERTAINING TO LICENSING AND CERTIFICATION TO PERFORM ABORTIONS, SO AS TO INCLUDE FACILITIES IN WHICH FIRST TRIMESTER ABORTIONS ARE PERFORMED AND PROVIDE FOR THE PROMULGATION OF REGULATIONS FOR THE DISPOSAL OF FETAL TISSUE AND REMAINS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. The 1976 Code is amended by adding:
"Section 44-41-75. A hospital and clinic performing abortions in this State must be licensed and certified pursuant to the regulations provided in Section 44-41-70. The department by regulation shall fix a schedule of reasonable fines and civil penalties relating to violations of this section. The department in accordance with the laws of the State governing injunctions and other processes may maintain an action in the name of the State for a violation of the provisions of this chapter."
SECTION 2. Section 44-41-70 of the 1976 Code is amended to read:
"Section 44-41-70. (A) The department shall promulgate and enforce rules and regulations for the certification of hospitals as defined in Section 44-41-10(d) as suitable facilities for the performance of abortions.
(B) The department shall promulgate and enforce rules and regulations for the licensing and certification of facilities other than hospitals as defined in Section 44-41-10(d) wherein in which abortions are to be performed as provided for in Section 44-41-20(a) or (b).
(C) The department shall promulgate and enforce regulations for the disposal of fetal tissue and remains."
SECTION 3. This act takes effect upon approval by the Governor.
