A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 15-1-325 SO AS TO PROVIDE THAT A PERSON COMMITS THE INTENTIONAL TORT OF "ASSAULT BY THREAT" IF THAT PERSON BY AN ACT OF WORDS OR OTHER COMMUNICATION STATES TO ANOTHER PERSON THAT HE WILL BE SUBJECT TO A PHYSICAL DANGER AT THE HANDS OF THE UTTERER SUCH THAT THE ACT PUTS THE ONE THREATENED IN IMMEDIATE APPREHENSION OF A FUTURE, BUT NOT IMMINENT, ACT OF PHYSICAL VIOLENCE.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 15-1-325. A person commits the intentional tort of `assault by threat' if that person by an act of words or other communication states to another person that he will be subject to a physical danger at the hands of the utterer such that the act puts the one threatened in immediate apprehension of a future, but not imminent, act of physical violence."

SECTION 2. This act takes effect upon approval by the Governor.
