A BILL

TO AMEND THE CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 39-1-75 SO AS TO PROVIDE THAT IF AN OPTICAL SCANNER USED BY ANY RETAIL VENDOR OVERCHARGES FOR AN ITEM PURCHASED, THE PURCHASER IS ENTITLED TO A REFUND OF THREE TIMES THE PURCHASE PRICE OF THE ITEM OR FIVE DOLLARS, WHICHEVER IS LESS, AND TO PROVIDE CIVIL PENALTIES FOR VIOLATIONS.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. The 1976 Code is amended by adding:

"Section 39-1-75. If an optical scanner used by any retail vendor overcharges for an item purchased, the purchaser is entitled to a refund of three times the purchase price of the item or five dollars, whichever is less.

Any retail vendor who refuses to pay the refund as required by this section upon demand by the purchaser is subject to a civil penalty of one hundred dollars for each violation, which may be imposed by and must be paid to the Department of Consumer Affairs."

SECTION 2. This act takes effect upon approval by the Governor.
