TO AMEND CHAPTER 31, TITLE 5, CODE OF LAWS OF SOUTH CAROLINA, 1976, BY ADDING SECTION 5-31-215 SO AS TO PROVIDE A MECHANISM FOR THE ADDITION OF EX OFFICIO MEMBERS ON A COMMISSION OF PUBLIC WORKS IN CITIES WITH MORE THAN THIRTY THOUSAND RESIDENTS AND LESS THAN FIFTY THOUSAND RESIDENTS.
Be it enacted by the General Assembly of the State of South Carolina:
SECTION 1. Chapter 31, Title 5 of the 1976 Code is amended by adding:
"Section 5-31-215. (A) In cities of more than thirty thousand residents and fewer than fifty thousand residents, according to the most recent official United States Census, in addition to the commissioners of public works to be elected as provided in Section 5-31-210, the mayor and the chairman of the committee on water supply, if there is a committee, are ex officio commissioners of public works, if:
(1) requested by a resolution approved by seventy-five percent or more of the commissioners of public works; and
(2) authorized by an ordinance approved by seventy-five percent or more of the members of the council of the municipality.
(B) The board of commissioners of public works in the city shall fill a vacancy occurring on the commission by appointment for the unexpired term. The appointment must be made by the remaining commissioners, except in the case of an ex officio member of the commission."
SECTION 2. This act takes effect upon approval by the Governor.
