Deliberations were opened with prayer by the Chaplain of the House of Representatives, the Rev. Dr. Alton C. Clark as follows:

Our today's prayer was written by Rep. Claude V. Marchbanks. I feel that it is so well done, both as to content and composition, that I would like to share it with you this morning.

Let us pray:

Gracious Lord, as this new day dawns, thank You for the newness of life.

We are grateful for the absence of hate and the presence of love; for the nearness of loved ones and the comfort they provide.

Thank You for the absence of pain and the presence of healthy bodies and minds; thank You for the cries of the newborn, for the hush of the new morn.

For the bereaved give comfort, for the old give peace, for the distressed provide calmness, for the discouraged send a friend.

For those who have forgotten, provide another opportunity; for those who have plenty, help them to see through the eyes of benevolence.

If we think more highly of ourselves than we should, bend us low enough to feel someone else's burden.

Above all, if we love YOU less than we should, forgive us, and refill our hearts with a double portion of that love of God which transcends all others.

Pursuant to Rule 6.3, the House of Representatives was led in the Pledge of Allegiance to the Flag of the United States of America by the SPEAKER.

After corrections to the Journal of the proceedings of yesterday, the SPEAKER ordered it confirmed.

MOTION ADOPTED

Rep. CLYBURN moved that when the House adjourns, it adjourn in memory of James A. Taylor of Aiken, which was agreed to.

The Judiciary Committee proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\BR1\18467AC.95), which was adopted.

Amend the bill, as and if amended, Section 20-7-1670, page 1, line 39, by deleting /20-7-1690/ and inserting /20-7-1690(F)/ so that when amended the second paragraph of Section 20-7-1670 reads:

"Before a child is placed within or outside the boundaries of this State for adoption with nonresidents of this State, compliance with Subarticle 11, Article 11, Chapter 7 of Title 20 (Interstate Compact on the Placement of Children) is required, and a judicial determination must be made in this State that one of the circumstances in items (a) through (e) of this section applies, whether or not the adoption proceedings are instituted in South Carolina. Additionally, in order to determine if any of the circumstances in items (a) through (e) of this section apply so as to permit placement with a nonresident for the purpose of adoption or adoption by a nonresident, a petition may be brought for the determination before the birth of the child or before placement of the child with the prospective adoptive parents. In ruling on this question the court must include in its order specific findings of fact as to the circumstances allowing the placement of a child with a nonresident or the adoption of a child by a nonresident. The court also must analyze the facts against the objective criteria established in Sections 16-3-1060 and 20-7-1690(F) and make specific findings in accordance with the pertinent law and evidence presented. The order resulting from this action does not prohibit or waive the right to refuse to consent to a release of rights or relinquish rights at a later time nor to withdraw a consent or relinquish at a later time as provided in this chapter. The order must be merged with and made a part of any subsequent adoption proceeding initiated in South Carolina."/

Amend further, by adding after Section 1:

/SECTION     2.     Section 20-7-1700(A) of the 1976 Code, as last amended by Act 653 of 1988, is further amended to read:

"(A)     Consent or relinquishment for the purpose of adoption, pursuant to Section 20-7-1690, must be made by a sworn document, signed by the person or the head of the agency giving consent or relinquishment after the birth of the adoptee, and shall specify the following:

(1)     the permanent address of the person or agency making the sworn written statement;

(2)     the date, time, and place of the signing of the statement;

(3)     the date of birth, race, and sex of the adoptee and any names by which the adoptee has been known;

(4)     the relationship of the adoptee to the person or agency giving consent or relinquishment;

(5)     the name and address of the adoptee's mother or father;

(6)     that the consent or relinquishment by the person or agency forfeits all rights and obligations of the person or agency with respect to the named adoptee;

(7)     that consent or relinquishment once given must not be withdrawn except by order of the court upon a finding that it is in the best interests of the child, and that the consent or relinquishment was not given voluntarily or was obtained under duress or through coercion; and that the entry of the final decree of adoption renders any consent or relinquishment irrevocable;

(8)     that the person or agency giving the consent or relinquishment understands that consent or relinquishment must not be given if psychological or legal advice, guidance, or counseling is needed or desired and that none is needed or desired;

(9)     that the person or agency giving the consent or relinquishment waives further notice of the adoption proceedings, unless the proceedings are contested by another person or agency;

(10)     that the person or agency giving the consent or relinquishment is doing so voluntarily, and the consent or relinquishment is not being obtained under duress or through coercion; and.

(11)     that the person or agency giving the consent or relinquishment has received a copy of the document./

/SECTION     1.     Section 20-4-70 of the 1976 Code is amended to read:

"Section 20-4-70.     (A)     Any An order of protection issued under subsection (a) of Section 20-4-60 shall must be for a fixed time not to exceed six months, but of a minimum of six months not to exceed one year unless the parties have reconciled as evidenced by an order of dismissal and may be extended by order of the court upon motion by the petitioner, showing good cause, with notice to the respondent. A respondent shall have has the right to a hearing on the extension of an order issued pursuant to this section within thirty days of the date upon which the order will expire.

(B)     Any Provisions included in an order of protection granting relief pursuant to Section 20-4-60(c) shall dissolve without motion sixty days must be enforced until further order of the court following the issuance of such the order unless, prior to before the expiration of such the period, the court has scheduled a hearing pursuant to the filing of an action for divorce or separate support and maintenance to determine the temporary rights and obligations of the parties with respect to support of a spouse or children, custody and visitation, or the distribution of personal property. If such the hearing has been scheduled, relief granted under Section 20-4-60(c) shall remain remains in effect beyond the sixty day period only until an order pursuant to the hearing is issued by the court.

(C)     The Family Court may modify the terms of any order issued under this section.

(D)     Any An order of protection issued by a magistrate shall expire expires as provided under the terms of the order or upon the issuance of a subsequent order by the Family Court, whichever occurs first."

SECTION     2.     This act takes effect upon approval by the Governor./

/SECTION ___.     A.     Article 3, Chapter 9, Title 61 of the 1976 Code is amended by adding:

"Section 61-9-415.     (A)     In addition to any other licensing requirements provided by law, a holder of a permit authorizing the sale of beer who sells beer by the keg for off premise consumption must comply with the provisions of this section. No person may be issued a permit to sell beer or wine unless the person complies with the provisions of this section.

(B)     For purposes of this section, a 'keg of beer' or 'keg beer' means a brewery sealed, individual container of beer having a liquid capacity of seven gallons or more.

(C)     The retailer shall maintain a record in which is recorded the name, address, date of birth, driver's license number of the person obtaining the keg, and the keg number if available. If the keg has no number from the manufacturer, a self-adhesive sticker numbered sequentially must be affixed to the keg and its number recorded. The retailer shall retain records for not less than six months and these records may be reviewed by any law enforcement officer upon request.

(D)     The retailer shall require a deposit of not less than fifty dollars for the keg's return which must be paid in cash, by check, or by credit card. If a keg is not returned, the deposit must be forfeited to the retailer. The dealer shall inform the person obtaining the keg of the deposit forfeit policy.

(E)     The expenses of complying with this action must be passed directly to the consumer in the price of a keg of beer.

(F)     The requirements of this section are cumulative to all requirements regulating retail sales and purchases of beer and a violation of any provision of this section is a ground for the revocation or suspension of the retailer's permit."

B.     This section takes effect July 1, 1995./

The Judiciary Committee proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\DKA\4050CM.95), which was adopted.

Amend the bill, as and if amended, by adding appropriately numbered SECTIONS to read:

/SECTION     __.     Section 16-25-60 of the 1976 Code, as last amended by Act 519 of 1994, is further amended to read:

"Section 16-25-60.     (A)     Unless the complaint is voluntarily dismissed or the charge is dropped prior to the scheduled trial date, a person charged with a violation provided in this chapter shall appear before a judge for disposition of the case.

(B)     When a person is convicted of a violation of Section 16-25-20 or 16-25-50, the court may suspend the imposition or execution of all or part of the sentence conditioned upon the participation of the offender completing, to the satisfaction of the court, in a program designed to treat battering spouses where available or in other appropriate psychiatric or therapeutic treatment or counseling.

(C)     When a person is convicted of a violation of Section 16-25-40 or 16-25-65, the court may suspend execution of all or part of the sentence and place the offender on probation, conditioned upon:

(1)     the participation of the offender completing, to the satisfaction of the court, in a program designed to treat battering spouses where available or in other appropriate psychiatric or therapeutic treatment or counseling;

(2)     fulfillment of all the obligations arising under court order pursuant to Section 20-4-60 and this section;

(3)     other reasonable terms and conditions of probation as the court may determine necessary to ensure the protection of the victim.

(D)     In determining whether or not to suspend the imposition or execution of all or part of a sentence as provided in this section, the court must consider the nature and severity of the offense, the number of times the offender has repeated the offense, and the best interests and safety of the victim. A court may require an offender to pay for participation in a program or treatment or counseling as an appropriate term or condition for suspending the imposition or execution of all or part of a sentence."

SECTION     __.     Section 20-4-70 of the 1976 Code is amended to read:

"Section 20-4-70.     (A)     Any An order of protection issued under subsection (a) of Section 20-4-60 shall must be for a fixed time not to exceed six months, but of a minimum of six months not to exceed one year unless the parties have reconciled as evidenced by an order of dismissal and may be extended by order of the court upon motion by the petitioner, showing good cause, with notice to the respondent. A respondent shall have has the right to a hearing on the extension of an order issued pursuant to this section within thirty days of the date upon which the order will expire.

(B)     Any Provisions included in an order of protection granting relief pursuant to Section 20-4-60(c) shall dissolve without motion sixty days must be enforced until further order of the court following the issuance of such the order unless, prior to before the expiration of such the period, the court has scheduled a hearing pursuant to the filing of an action for divorce or separate support and maintenance to determine the temporary rights and obligations of the parties with respect to support of a spouse or children, custody and visitation, or the distribution of personal property. If such the hearing has been scheduled, relief granted under Section 20-4-60(c) shall remain remains in effect beyond the sixty day period only until an order pursuant to the hearing is issued by the court.

(C)     The Family Court may modify the terms of any order issued under this section.

(D)     Any An order of protection issued by a magistrate shall expire expires as provided under the terms of the order or upon the issuance of a subsequent order by the Family Court, whichever occurs first."

SECTION     __.     The 1976 Code is amended by adding:

"Section 56-5-2780.     (A)     A driver of a vehicle violating Section 56-5-2770(a) or (e) is guilty of a misdemeanor and, upon conviction, entry of a plea of guilty or nolo contendere, or forfeiture of bail for a first offense must be fined not less than one thousand five hundred dollars or imprisoned not more than thirty days. In lieu of imprisonment, the court may require that the individual complete an appropriate term of community service of not fewer than ten days upon terms and conditions the court considers proper. Upon conviction, entry of a plea of guilty or nolo contendere, or forfeiture of bail for a second or subsequent violation of Section 56-5-2770(a) or (e), a person is guilty of a misdemeanor and must be fined not less than two thousand dollars or more than five thousand dollars or imprisoned for not fewer than thirty days and not more than sixty days.

(B)     If a driver of a vehicle violates Section 56-5-2770(a) or (e), and the violation proximately causes great bodily injury or death to a pedestrian, the person is guilty of a felony and, upon conviction, entry of a plea of guilty or nolo contendere, or forfeiture of bond, the person must be:

(1)     fined not less than five thousand dollars or more than ten thousand dollars and imprisoned for not less than sixty days or more than one year when great bodily injury results;

(2)     fined not less than ten thousand dollars or more than twenty-five thousand dollars and imprisoned for not less than one year or more than five years when death results.

As used in this subsection, 'great bodily injury' means bodily injury which creates a substantial risk of death or which causes serious, permanent disfigurement or protracted loss or impairment of the function of any bodily member or organ.

The department shall suspend the driver's license of a person who is convicted or who receives a sentence upon a plea of guilty or nolo contendere pursuant to this subsection for the term of imprisonment plus one year."

SECTION     __.     Section 56-5-2775 of the 1976 Code, as last amended by Act 399 of 1992, is further amended to read:

"Section 56-5-2775.     The driver of a vehicle violating the provisions of Sections 56-5-2735 and 56-5-2770(a) or (e) is guilty of a misdemeanor and, upon conviction, must be punished by a fine of fined not less than one hundred dollars nor or more than two hundred dollars or imprisonment imprisoned for not more than thirty days."/

/SECTION __.     Section 34-11-70 of the 1976 Code, as last amended by Act 36 of 1991, is further amended to read:

"Section 34-11-70.     (a)     When a check, a draft, or other written order is not paid by the drawee because the maker or drawer did not have an account with or sufficient funds on deposit with the bank or the person upon which it was drawn when presented or the draft, check, or other written order has an incorrect or insufficient signature on it, and the maker or drawer does not pay the amount due on it, together with a service charge of twenty twenty-five dollars, within ten days after written notice has been sent by certified mail to the address printed on the check or given at the time it is tendered or provided on a check-cashing identification card stating that payment was refused upon the instrument, then it constitutes prima facie evidence of fraudulent intent against the maker. Service charges collected pursuant to this section must be paid to the payee of the instrument.

(1)     For purposes of subsection (a), notice must be given by mailing the notice with postage prepaid addressed to the person at the address as printed or written on the instrument. The giving of notice by mail is complete upon the expiration of ten days after the deposit of the notice in the mail. A certificate by the payee that the notice has been sent as required by this section is presumptive proof that the requirements as to notice have been met, regardless of the fact that the notice actually might not have been received by the addressee. The form of notice must be substantially as follows:

You are notified that a check or instrument, numbered ____, issued by you on ____ (date), drawn upon ____ (name of bank), and payable to ____, has been dishonored. Pursuant to South Carolina law, you have ten days from the date this notice was mailed to tender payment of the full amount of the check or instrument plus a service charge of twenty twenty-five dollars, the total amount due being __ dollars and ___ cents. Unless this amount is paid in full within the specified time above, the holder of the check or instrument may turn over the dishonored check or instrument and all other available information relating to this incident to the solicitor or other appropriate officer for criminal prosecution.

(2)     When a person instituting prosecution gives notice in substantially similar form provided in item (1) to the person and the bank upon which the instrument was drawn and waits ten days from the date notice is mailed before instituting the criminal proceedings, there arises a presumption that the prosecution was instituted for reasonable and probable cause, and the person instituting prosecution is immune from civil liability for the giving of the notice.

(3)     A service charge of not more than twenty twenty-five dollars is payable by the drawer of a draft, a check, or other written order to the payee of the instrument when the draft, check, or other written order is presented for payment in whole or in part of a then existing debt, including, but not limited to, consumer credit transactions, and is dishonored. This service charge is solely to compensate the payee of the instrument for incurred expenses in processing the dishonored instrument and is not related to a presumption of fraud so that it is not necessary to issue the notice to the person at the address as printed on the instrument set forth in items (1) and (2).

(b)     Any court, including magistrate's, may dismiss a case under the provisions of this chapter for want of prosecution. When any prosecutions are initiated under this chapter, the party applying for the warrant is held liable for all reasonable administrative costs accruing not to exceed twenty dollars if the case is dismissed for want of prosecution. Unless waived by the court, the party applying for the warrant shall notify, orally or otherwise, the court not less than twenty-four hours before the date and time set for trial that full restitution has been made in connection with the warrant, and the notification relieves that party of the responsibility of prosecution.

(c)     Any court, including magistrate's, may dismiss any prosecution initiated pursuant to the provisions of this chapter on satisfactory proof of restitution and payment by the defendant of all administrative costs accruing not to exceed twenty dollars submitted before the date set for trial after the issuance of a warrant.

(d)     For purposes of this chapter, subsequent persons receiving a check, draft, or other written order by endorsement from the original payee or a successor endorsee have the same rights that the original payee has against the maker of the instrument, if the maker of the instrument has the same defenses against subsequent persons as he may have had against the original payee. However, the remedies available under this chapter may be exercised only by one party in interest."/

The Judiciary Committee proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\DKA\4049CM.95), which was adopted.

Amend the bill, as and if amended, by striking Section 47-3-630 and inserting:

/Section 47-3-630.     Section 47-3-630 of the 1976 Code is amended to read:

"Section 47-3-630.     A person who violates any of the provisions of this article, except for Section 47-3-620, is guilty of a misdemeanor and, upon conviction, must be fined no not less than five hundred dollars and no nor more than one thousand dollars or imprisoned for no not less than thirty days or no nor more than six months, or both. A person who violates Section 47-3-620 is guilty of a misdemeanor and, upon conviction, must be fined not less than two thousand dollars nor more than five thousand dollars or imprisoned not less than one year nor more than three years, or both."/

"Section 47-3-610.     It is unlawful for a person to wilfully and maliciously taunt, torment, tease, beat, strike, or administer or subject any a desensitizing drug, chemical, or substance to a dog or horse used by a law enforcement department or agency in the performance of the functions or duties of the department or agency or when a dog is placed in a kennel off duty or a horse is placed in a stable off duty;, or to interfere or meddle with a dog or horse used by a law enforcement department or agency in the performance of the functions or duties of the department or agency."

SECTION     __.     Section 47-3-620 of the 1976 Code, as added by Act 512 of 1988, is amended to read:

"Section 47-3-620.     It is unlawful for a person to wilfully or maliciously torture, mutilate, injure, disable, poison, or kill a dog or horse used by a law enforcement department or agency in the performance of the functions or duties of the department or when a dog is placed in a kennel off duty or a horse is placed in a stable off duty. However, a police officer or veterinarian may perform euthanasia in emergency situations when delay would cause the dog or horse undue suffering and pain."/

The Agriculture, Natural Resources and Environmental Affairs Committee proposed the following Amendment No. 1 (Doc Name L:\council\legis\amend\PFM\7485BDW.95), which was adopted.

Amend the bill, as and if amended, Section 50-3-316, line 31, after /applicants./ by inserting /If an enforcement officer does not reside in the county or within fifteen miles of the county for which he is employed, he shall move to the county or within fifteen miles of the county at his expense within three months of employment./ so that when amended the section reads:

/Section 50-3-316.     The department shall, In employing enforcement officers, the department shall use the criteria as required by the Division of Human Resource Management and the department, which shall. The criteria must include, but is not limited to, a written examination, physical examination, and interview. Each applicant shall be is required to perform at minimal levels as required by the Division of Human Resource Management and the department. The department shall employ the most qualified applicants. If an enforcement officer does not reside in the county or within fifteen miles of the county for which he is employed, he shall move to the county or within fifteen miles of the county at his expense within three months of employment.

The department, when employing enforcement officers within a particular county, must hire those applicants, if any, who meet the minimum employment qualification requirements as required by the Division of Human Resource Management and the department and who reside within that particular county before the department may hire other qualified applicants who reside outside that county.

If more than one vacancy exists in a county, the resident candidate with the next highest score will be chosen to fill the second vacancy. Additional vacancies would be filled in the same manner.

If there are no candidates for that county who meet the minimum requirements, the vacancy will be filled by the top scoring candidate regardless of county of residence./

Whereas, the Hunley, a Confederate submarine, was commissioned by private investors and built in Mobile, Alabama, for use in the Civil War; and

Whereas, the Hunley torpedoed and destroyed on February 17, 1864, the USS Housatonic, a Union warship blockading Charleston Harbor; and

Whereas, that attack made the Hunley the first submarine in history to sink a warship; and

Whereas, the sinking of the USS Housatonic was the only such action in the Civil War; and

Whereas, the Hunley's achievement would not be repeated until the closing months of the First World War; and

Whereas, the Hunley's success launched the era of submarine warfare; and

Whereas, the Hunley and her crew disappeared off the coast of Charleston the night she sank the Housatonic; and

Whereas, nine gallant Confederate soldiers went down with the submarine; and

Whereas, the Hunley is the single most important artifact in the history of submarine warfare; and

Whereas, the Hunley has just been discovered intact off the coast of Sullivan's Island, South Carolina; and

Whereas, under federal and state law, the State asserts ownership of this vessel; and

Whereas, the State of South Carolina desires to exercise its ownership and control of this piece of Southern history; and

Whereas, the members of the General Assembly, by this resolution, declare their belief that this historic relic must be preserved and maintained for the benefit of future generations, and that the Hunley's history is inextricably tied to that of South Carolina's; and

Whereas, if subsequent events or proceedings should find and dictate that the State cannot legally assert ownership to this property, the State would want to pursue obtaining ownership from the entity found to own the ship, and if it is determined that ownership of the vessel belongs to the General Services Administration, the State requests transfer of ownership to the State. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the remains of the CSS Hunley, a Confederate attack submarine which sank off the coast of South Carolina on February 17, 1864, is the property of the State of South Carolina, the members of the General Assembly hereby memorialize the United States Congress to direct the General Services Administration to transfer any interest they may have in the wreckage of the Confederate submarine, the Hunley, to the State of South Carolina for enshrinement at the Naval Marine Museum at Patriot's Point, located in Mount Pleasant, South Carolina.

Be it further resolved that a committee of nine members be appointed, three of whom must be members of the House of Representatives, to be appointed by the Speaker, three of who must be members of the Senate to be appointed by the President Pro Tempore, and three members to be appointed by the Governor. The committee shall make a study of the law regarding the rights to the salvage of the "Hunley," a Confederate submarine, and any claim that a person or entity may assert with regard to ownership or control of the vessel. The committee is authorized to direct the Attorney General on behalf of South Carolina to take appropriate steps to enforce and protect the rights of the State of South Carolina to the salvage of the Hunley and to defend the state against claims regarding this vessel and to make recommendations regarding the appropriate method of preservation of this historic vessel.

The committee members shall not receive the subsistence, mileage and per diem as may be provided by law for members of boards, committees and commissions.

Be it further resolved that a copy of this resolution be forwarded to the President of the United States, the United States Senate, the United States House of Representatives, and the members of South Carolina's Congressional Delegation.

This veto is based upon my belief that S. 732, R. 78 of 1995, is unconstitutional. It is clearly an act for a specific county. Article VIII, Section 7 states that "[n]o laws for a specific county shall be enacted."

For the above reason, I am returning S. 732, R. 78, without my signature.

If a local government's fine exceeds two hundred dollars, then that amount must be placed on the identification sign. Omission of the fine on an identifying sign is not a defense to a prosecution for unlawful use of a handicapped parking place./

"Section 22-3-550.     Magistrates have jurisdiction of all offenses which may be subject to the penalties of a fine or forfeiture not exceeding five hundred dollars, or imprisonment not exceeding thirty days, or both and may impose any sentence within those limits, singly or in the alternative. In addition, a magistrate may order restitution he considers appropriate.

However, a magistrate shall not have the power to sentence any person to consecutive terms of imprisonment totaling more than ninety days except for convictions resulting from violations of Chapter 11 of Title 34 pertaining to fraudulent checks, violations of Section 16-13-10, relating to forgery which involves a check, or violations of Section 16-13-110, relating to shoplifting. Further, a magistrate must specify an amount of restitution and damages at the time of sentencing as an alternative to any imprisonment of more than ninety days which is lawfully imposed. The provisions of this paragraph do not effect affect the transfer of criminal matters from the general sessions court made pursuant to Section 22-3-545."/

Whereas, the Honorable C. Lem Harper, Sr., is a graduate of Columbia High School and attended the University of South Carolina and the Extension Division Real Estate School; and

Whereas, his record exemplifies one of performance and integrity. The following positions have been achieved through hard work and dedication: he has been president of C. Lem Harper Tailoring for fifty years; he served on the South Carolina Coordinating Council for Economic Development; he is past president of the South Carolina and Columbia Junior Chamber of Commerce; he is the past president of the Southern Conference of Football Officials Association; he is a member of the Richland Sertoma Club; he has served as a potentate's aide for the Jamil Shrine Temple; he is past National Americanism Chairman of the United States Jaycees; he served in the South Carolina House of Representatives from 1967-71, and in the House he served on the Education and Public Works Committee and the Military, Public and Municipal Affairs Committee; and he was elected by the General Assembly to serve as commissioner of the South Carolina Employment Security Commission in 1971, and has served continuously on the commission ever since; and

Whereas, Lem Harper has been an outstanding member of the Employment Security Commission and has long been an excellent and dedicated public servant; and

Whereas, he is a truly distinguished South Carolinian who has given most generously of his time and talents to the people of the Palmetto State for many years, and it would indeed be most fitting and appropriate that his services be honored by naming for him the new building at the Employment Security Commission's Columbia Complex. Now, therefore,

Be it resolved by the Senate, the House of Representatives concurring:

That the General Assembly of the State of South Carolina, by this resolution, requests the Employment Security Commission to take the necessary steps to ensure that the new building at the offices of the commission be named for the Honorable C. Lem Harper, Sr., of Columbia.

(2)     No provision of this act or any other provision of law shall affect detrimentally or diminish efforts by the State of South Carolina and its agencies to notify and include South Carolina businesses owned and controlled by socially and economically disadvantaged ethnic minorities and disadvantaged females in contract negotiations involving the State of South Carolina and its agencies./
