A BILL

TO AMEND SECTION 40-1-50, CODE OF LAWS OF SOUTH CAROLINA, 1976, RELATING TO RESPONSIBILITIES AND AUTHORITY OF THE DEPARTMENT OF LABOR, LICENSING AND REGULATION, SO AS TO PROVIDE THAT FUNDS DEPOSITED IN A SPECIAL REVENUE ACCOUNT OF THE DEPARTMENT MUST NOT BE TRANSFERRED FOR USE FOR OTHER PURPOSES.

Be it enacted by the General Assembly of the State of South Carolina:

SECTION 1. Section 40-1-50(D) of the 1976 Code is amended by adding:

"(5) Fees deposited in a special revenue account established for each respective board must not be transferred from that account for a purpose other than the designated use for operation of the occupation or profession by which the funds were generated. A special revenue account established for a board pursuant to this section is exempt from any provision of law or rule or regulation purporting to transfer its funds for use for another purpose."

SECTION 2. This act takes effect upon approval by the Governor.
